COUNCIL RECOMMENDATION of 9 March 1998 concerning the discharge to be given to the Commission in respect of the implementation of the operations of the European Development Fund (1989) (Seventh EDF) for the financial year 1996 (98/218/EC)

DER RAT DER EUROPÄISCHEN UNION -

THE COUNCIL OF THE EUROPEAN UNION,

gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft, insbesondere auf Artikel 206,

Having regard to the Treaty establishing the European Community, and in particular Article 206 thereof,

gestützt auf das am 15. Dezember 1989 in Lomé unterzeichnete Vierte AKP-EWG-Abkommen,

Having regard to the Fourth ACP-EEC Convention, signed at Lomé on 15 December 1989,

gestützt auf den Beschluß 91/482/EWG des Rates vom 25. Juli 1991 über die Assoziation der überseeischen Länder und Gebiete mit der Europäischen Wirtschaftsgemeinschaft (1),

Having regard to Council Decision 91/482/EEC of 25 July 1991 on the association of the overseas countries and territories with the European Economic Community (1),

gestützt auf das am 16. Juli 1990 in Brüssel unterzeichnete Interne Abkommen über die Finanzierung und Verwaltung der Hilfe der Gemeinschaft (2), insbesondere auf Artikel 33 Absatz 3,

Having regard to the Internal Agreement on the financing and administration of Community aid (2), signed in Brussels on 16 July 1990, and in particular Article 33(3) thereof,

gestützt auf die Finanzregelung vom 29. Juli 1991 für den 7. Europäischen Entwicklungsfonds (3), insbesondere auf die Artikel 69 bis 77,

Having regard to the Financial Regulation of 29 July 1991 applicable to the Seventh European Development Fund (3), and in particular Articles 69 to 77 thereof,

nach Prüfung der zum 31. Dezember 1996 festgestellten Haushaltsrechnung und der Übersicht betreffend die Rechnungsvorgänge des Europäischen Entwicklungsfonds (1989) (7. EEF) sowie des Berichts des Rechnungshofs zum Haushaltsjahr 1996 mit den Antworten der Kommission (4),

Having examined the revenue and expenditure account and the balance sheet relating to the operations of the European Development Fund (1989) (Seventh EDF) as at 31 December 1996 and the Court of Auditors' report relating to the financial year 1996 together with the Commission's replies (4),

in Erwägung nachstehender Gründe:

Whereas, pursuant to Article 33(3) of the Internal Agreement, the discharge for the management of the European Development Fund (1989) (Seventh EDF) must be given to the Commission by the European Parliament on a recommendation from the Council;

Nach Artikel 33 Absatz 3 des Internen Abkommens wird der Kommission die Entlastung hinsichtlich der Verwaltung des Europäischen Entwicklungsfonds (1989) (7. EEF) vom Europäischen Parlament auf Empfehlung des Rates erteilt.

Whereas the overall implementation by the Commission of the operations of the European Development Fund (1989) (Seventh EDF) during the financial year 1996 has been satisfactory,

Die Kommission hat die Rechnungsvorgänge des Europäischen Entwicklungsfonds (1989) (7. EEF) im Haushaltsjahr 1996 insgesamt zufriedenstellend ausgeführt -

HEREBY RECOMMENDS

EMPFIEHLT

that the European Parliament give the Commission a discharge in respect of the implementation of the operations of the European Development Fund (1989) (Seventh EDF) for the financial year 1996.

dem Europäischen Parlament, der Kommission Entlastung zur Ausführung der Rechnungsvorgänge des Europäischen Entwicklungsfonds (1989) (7. EEF) für das Haushaltsjahr 1996 zu erteilen.
