Oktober 1996 über den Abschluß des Abkommens in Form eines Briefwechsels zwischen der Europäischen Gemeinschaft und der Arabischen Republik Ägypten zur Anpassung der Regelung für die Einfuhr von Orangen mit Ursprung in und Herkunft aus Ägypten in die Gemeinschaft (96/641/EG)

COUNCIL DECISION of 28 October 1996 on the conclusion of an Agreement in the form of an exchange of letters between the European Community and the Arab Republic of Egypt on the adjustment of the regime for imports into the Community of oranges originating in and coming from Egypt (96/641/EC)

DER RAT DER EUROPÄISCHEN UNION -

THE COUNCIL OF THE EUROPEAN UNION,

gestützt auf den Vertrag zur Gründung der Europäischen Gemeinschaft, insbesondere auf Artikel 113 in Verbindung mit Artikel 228 Absatz 2 Satz 1,

Having regard to the Treaty establishing the European Community, and in particular Article 113 thereof, in conjunction with the first sentence of Article 228 (2) thereof,

auf Vorschlag der Kommission,

Having regard to the proposal from the Commission,

in Erwägung nachstehender Gründe:

Whereas, in the context of the Uruguay Round of multilateral trade negotiations, the import regime for oranges has been changed;

Im Rahmen der multilateralen Handelsverhandlungen der Uruguay-Runde wurde die Einfuhrregelung für Orangen geändert.

Whereas this new regime may have a negative effect on the Community's traditional imports from Egypt;

Diese neue Regelung kann sich nachteilig auf die herkömmlichen Einfuhren der Gemeinschaft aus Ägypten auswirken.

Whereas Article 22 of the Cooperation Agreement between the European Economic Community and the Arab Republic of Egypt (1) provides that, where the existing rules are modified, the Community may amend the regime set out in the Agreement for the products concerned;

Gemäß Artikel 22 des Kooperationsabkommens zwischen der Europäischen Wirtschaftsgemeinschaft und der Arabischen Republik Ägypten (1) kann die Gemeinschaft im Fall einer Änderung der bestehenden Regelung die in dem Abkommen vorgesehene Regelung für die entsprechenden Waren ändern.

Whereas the Community has agreed with the Arab Republic of Egypt that, pending the conclusion of a new Euro-Mediterranean Agreement, the said regime will be adjusted on the basis of an Agreement in the form of an exchange of letters;

Die Gemeinschaft hat mit der Arabischen Republik Ägypten vereinbart, daß die fragliche Regelung bis zum Abschluß eines neuen Europa-Mittelmeer-Abkommens auf der Grundlage eines Abkommens in Form eines Briefwechsels angepaßt wird.

Whereas the latter Agreement should now be approved,

Dieses letztgenannte Abkommen sollte nunmehr genehmigt werden -

HAS DECIDED AS FOLLOWS:

BESCHLIESST:

Article 1

Artikel 1

The Agreement in the form of an exchange of letters between the European Community and the Arab Republic of Egypt on the adjustment of the regime for imports into the Community of oranges originating in and coming from Egypt is hereby approved on behalf of the Community.

Das Abkommen in Form eines Briefwechsels zwischen der Europäischen Gemeinschaft und der Arabischen Republik Ägypten zur Anpassung der Regelung für die Einfuhr von Orangen mit Ursprung in und Herkunft aus Ägypten in die Gemeinschaft wird im Namen der Gemeinschaft genehmigt.

The text of the Agreement is attached to this Decision.

Der Wortlaut des Abkommens ist diesem Beschluß beigefügt.

Article 2

Artikel 2

The President of the Council is hereby authorized to designate the person empowered to sign the Agreement in order to bind the Community (2).

Der Präsident des Rates wird ermächtigt, die Person zu bestellen, die befugt ist, das Abkommen rechtsverbindlich für die Gemeinschaft zu unterzeichnen (2).

Article 3

Artikel 3

If necessary, the Commission shall adopt detailed rules for the application of the Agreement, in accordance with the procedure provided for in Article 33 of Regulation (EEC) No 1035/72 (3).

Erforderlichenfalls erläßt die Kommission nach dem Verfahren des Artikels 33 der Verordnung (EWG) Nr. 1035/72 (3) Durchführungsbestimmungen zu dem Abkommen.
