RÅDET FOR DEN EUROPÆISKE UNION HAR —

THE COUNCIL OF THE EUROPEAN UNION,

under henvisning til traktaten om Den Europæiske Unions funktionsmåde, særlig artikel 100, stk. 2, sammenholdt med artikel 218, stk. 5,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 100(2), in conjunction with Article 218(5) thereof,

under henvisning til forslag fra Europa-Kommissionen, og

Having regard to the proposal from the European Commission,

ud fra følgende betragtninger:

Whereas:

(1) Rådet bemyndigede i sin afgørelse af 5. juni 2003 Kommissionen til at indlede forhandlinger med tredjelande om en EU-aftale, som skulle træde i stedet for visse bestemmelser i eksisterende bilaterale aftaler.

(1) In its Decision of 5 June 2003, the Council authorised the Commission to open negotiations with third countries on the replacement of certain provisions in existing bilateral agreements with an agreement at Union level.

(2) På Unionens vegne har Kommissionen forhandlet en aftale med Republikken Kap Verde om visse aspekter af lufttrafik ("aftalen") i overensstemmelse med de mekanismer og direktiver, der er fastsat i bilaget til Rådets afgørelse af 5. juni 2003.

(2) On behalf of the Union, the Commission negotiated an Agreement with the Republic of Cape Verde on certain aspects of air services (the Agreement) in accordance with the mechanisms and directives in the Annex to the Council Decision of 5 June 2003.

(3) Aftalen bør undertegnes og anvendes midlertidigt med forbehold af dens indgåelse —

(3) The Agreement should be signed and provisionally applied subject to its conclusion,

VEDTAGET DENNE AFGØRELSE:

HAS ADOPTED THIS DECISION:

Artikel 1

Article 1

Undertegnelsen af aftalen mellem Den Europæiske Union og Republikken Kap Verde om visse aspekter af lufttrafik ("aftalen") godkendes herved på Unionens vegne med forbehold af indgåelse af aftalen.

The signing of the Agreement between the European Union and the Republic of Cape Verde on certain aspects of air services (the Agreement) is hereby approved on behalf of the Union, subject to the conclusion of the said Agreement.

Teksten til aftalen er knyttet til denne afgørelse.

The text of the Agreement is attached to this Decision.

Artikel 2

Article 2

Formanden for Rådet bemyndiges til at udpege den eller de personer, der på Unionens vegne er beføjet til at undertegne aftalen med forbehold af dens indgåelse.

The President of the Council is hereby authorised to designate the person(s) empowered to sign the Agreement on behalf of the Union subject to its conclusion.

Artikel 3

Article 3

Indtil aftalen træder i kraft, anvendes den midlertidigt fra den første dag i den første måned efter den dato, hvor parterne har givet hinanden notifikation om afslutningen af de procedurer, der er nødvendige i så henseende [1].

Pending its entry into force, the Agreement shall be applied provisionally from the first day of the first month following the date on which the parties have notified each other of the completion of the necessary procedures for this purpose [1].

Artikel 4

Article 4

Formanden for Rådet bemyndiges herved til at foranstalte den notifikation, der er omhandlet i aftalens artikel 8, stk. 2.

The President of the Council is hereby authorised to make the notification provided for in Article 8(2) of the Agreement.

Artikel 5

Article 5

Denne afgørelse træder i kraft på dagen for vedtagelsen.

This Decision shall enter into force on the date of its adoption.
