s ohledem na Smlouvu o založení Evropského společenství, a zejména na čl. 61 písm. c) a článek 67 ve spojení s čl. 300 odst. 2 prvním pododstavcem a. s čl. 300 odst. 3 druhým pododstavcem této smlouvy,

Having regard to the Treaty establishing the European Community, and in particular Article 61(c) and Article 67 in conjunction with Article 300(2), first subparagraph, and Article 300(3), second subparagraph, thereof,

s ohledem na návrh Komise,

Having regard to the proposal from the Commission,

s ohledem na souhlas Evropského parlamentu,

Having regard to the assent of the European Parliament,

vzhledem k těmto důvodům:

Whereas:

(1) Protokol ze dne 12. února 2004 (dále jen "protokol"), kterým se mění Úmluva ze dne 29. července 1960 o odpovědnosti vůči třetím stranám v oblasti jaderné energie, pozměněná dodatkovým protokolem ze dne 28. ledna 1964 a protokolem ze dne 16. listopadu 1982 (dále jen "Pařížská úmluva"), obsahuje ustanovení, která se dotýkají pravidel stanovených v nařízení Rady (ES) č. 44/2001 ze dne 22. prosince 2000 o příslušnosti a uznávání a výkonu soudních rozhodnutí v občanských a obchodních věcech [1]. Jde o oblast, v níž má Společenství výlučnou pravomoc.

(1) The Protocol of 12 February 2004 (hereinafter referred to as "the Protocol") amending the Convention of 29 July 1960 on Third-Party Liability in the Field of Nuclear Energy, as amended by the Additional Protocol of 28 January 1964 and by the Protocol of 16 November 1982 (hereinafter referred to as "the Paris Convention") contains provisions which affect the rules laid down in Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters [1]. This is a field in which the Community has exclusive competence.

(2) Rozhodnutím 2003/882/ES [2] Rada zmocnila členské státy, které jsou smluvními stranami Pařížské úmluvy, k podpisu protokolu v zájmu Společenství.

(2) By Decision 2003/882/EC [2] the Council authorised the Member States which are Contracting Parties to the Paris Convention to sign the Protocol in the interest of the Community.

(3) Rozhodnutím 2004/294/ES [3] Rada zmocnila tytéž členské státy, aby v zájmu Společenství uvedený protokol ratifikovaly nebo k němu přistoupily. Podle článku 2 uvedeného rozhodnutí měly zmíněné členské státy učinit potřebné kroky k současnému uložení listin o ratifikaci protokolu nebo o přistoupení k němu, a to pokud možno do 31. prosince 2006.

(3) By Decision 2004/294/EC [3] the Council authorised the same Member States to ratify the Protocol in the interest of the Community or to accede to it. According to Article 2 of that Decision, the Member States were to take the necessary steps to deposit simultaneously their instruments of ratification of the Protocol, or of accession to it, if possible before 31 December 2006.

(4) Rozhodnutí 2004/294/ES bylo určeno těm členským státům, které byly součástí Společenství ke dni 8. března 2004, s výjimkou Rakouska, Dánska, Irska a Lucemburska, což jasně vyplývá ze společného použití čl. 1 odst. 3 a článku 4 uvedeného rozhodnutí.

(4) Decision 2004/294/EC was addressed to those Member States which were part of the Community on 8 March 2004, with the exception of Austria, Denmark, Ireland and Luxembourg, as is clear from the combined application of Article 1(3) and Article 4 of that Decision.

(5) Republika Slovinsko je smluvní stranou Pařížské úmluvy a protokol podepsala svým jménem dne 12. února 2004. Vzhledem k tomu, že rozhodnutí 2004/294/ES bylo určeno pouze některým členským státům, nemohla být Republika Slovinsko po svém přistoupení k Evropské unii dne 1. května 2004 považována za adresáta uvedeného rozhodnutí na základě článku 53 aktu o přistoupení z roku 2003.

(5) The Republic of Slovenia is a Contracting Party to the Paris Convention and signed the Protocol on its own behalf on 12 February 2004. Since Decision 2004/294/EC was addressed only to certain Member States, the Republic of Slovenia could not upon its accession to the European Union on 1 May 2004 be considered an addressee thereof by virtue of Article 53 of the Act of Accession of 2003.

(6) Spojené království a Irsko jsou vázány nařízením (ES) č. 44/2001, a účastní se proto přijímání tohoto rozhodnutí.

(6) The United Kingdom and Ireland are bound by Regulation (EC) No 44/2001 and are therefore taking part in the adoption of this Decision.

(7) V souladu s články 1 a 2 Protokolu o postavení Dánska, připojeného ke Smlouvě o Evropské unii a ke Smlouvě o založení Evropského společenství, se Dánsko neúčastní přijímání tohoto rozhodnutí, a proto pro ně není závazné ani použitelné.

(7) In accordance with Articles 1 and 2 of the Protocol on the position of Denmark annexed to the Treaty on European Union and to the Treaty establishing the European Community, Denmark does not take part in the adoption of this Decision and is not be bound by it or subject to its application.

(8) Ratifikací protokolu Republikou Slovinskem není dotčeno postavení členských států Společenství, které nejsou smluvními stranami Pařížské úmluvy,

(8) The ratification by the Republic of Slovenia of the Protocol is without prejudice to the position of the Member States of the Community which are not Contracting Parties to the Paris Convention,

PŘIJALA TOTO ROZHODNUTÍ:

HAS ADOPTED THIS DECISION:

Článek 1

Article 1

Aniž jsou dotčeny pravomoci Společenství, ratifikuje Republika Slovinsko v zájmu Společenství protokol, kterým se mění Pařížská úmluva.

Without prejudice to the Community’s powers, the Republic of Slovenia shall ratify, in the interest of the Community, the Protocol amending the Paris Convention.

Touto ratifikací není dotčeno postavení členských států Společenství, které nejsou smluvními stranami Pařížské úmluvy.

Such ratification shall be without prejudice to the position of those Member States of the Community which are not Contracting Parties to the Paris Convention.

Článek 2

Article 2

Republika Slovinsko učiní potřebné kroky k uložení své listiny o ratifikaci protokolu, pokud možno současně s členskými státy, jimž je určeno rozhodnutí 2004/294/ES.

The Republic of Slovenia shall take the necessary steps to deposit its instrument of ratification of the Protocol, if possible simultaneously with the Member States addressed by Decision 2004/294/EC.

Article 3

Při ratifikaci protokolu Republika Slovinsko písemně informuje generálního tajemníka Organizace pro hospodářskou spolupráci a rozvoj o tom, že ratifikace proběhla v souladu s tímto rozhodnutím.

When ratifying the Protocol, the Republic of Slovenia shall inform the Secretary-General of the Organisation for Economic Cooperation and Development in writing that ratification has taken place in accordance with this Decision.

Article 4

Toto rozhodnutí je určeno Republice Slovinsko.

This Decision is addressed to the Republic of Slovenia.
