amending Annex XIX (Consumer protection) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex XIX to the Agreement was amended by Decision of the EEA Joint Committee No 35/2010 of 12 March 2010 [1].

(2) Commission Recommendation 2010/304/EU of 12 May 2010 on the use of a harmonised methodology for classifying and reporting consumer complaints and enquiries [2] is to be incorporated into the Agreement.

(3) Commission Recommendation 2011/136/EU of 1 March 2011 guidelines for the implementation of data protection rules in the Consumer Protection Cooperation System (CPCS) [3] is to be incorporated into the Agreement,

HAS ADOPTED THIS DECISION:

Article 1

The following points shall be inserted after point 20 (Commission Recommendation 2001/193/EC) of Annex XIX to the Agreement:

"21. 32010 H 0304: Commission Recommendation 2010/304/EU of 12 May 2010 on the use of a harmonised methodology for classifying and reporting consumer complaints and enquiries (OJ L 136, 2.6.2010, p. 1).

22. 32011 H 0136: Commission Recommendation 2011/136/EU of 1 March 2011 guidelines for the implementation of data protection rules in the Consumer Protection Cooperation System (CPCS) (OJ L 57, 2.3.2011, p. 44).".

Article 2

The texts of Recommendations 2010/304/EU and 2011/136/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 31 March 2012, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee [****].

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
