Trečioji reglamentavimo aplinkos paprastinimo strategijos pažangos ataskaita

1. Įvadas

Per pastaruosius 50 metų ES tenkindama piliečių, bendrovių ir viešojo administravimo institucijų poreikius priėmė daugybę teisės aktų (acquis). Ji suteikė piliečiams naujų teisių, bendrovėms atvėrė rinkas, sustiprino viešuosius interesus ir taip prisidėjo prie didesnio augimo bei gerovės. Tačiau teisės aktai taip pat gali būti susiję su sąnaudomis. Bėgant laikui ir keičiantis aplinkybėms sunku rasti tinkamą pusiausvyrą.

Todėl kadencijos pradžioje Komisija tvirtai įsipareigojo peržiūrėti acquis ir užtikrinti galiojančių teisės aktų aktualumą, veiksmingumą ir proporcingumą [1]. Reglamentavimo aplinkos paprastinimo strategijoje, apimančioje lygiagrečią administracinės naštos mažinimo programą [2], nustatyta plataus užmojo ES reglamentavimo sistemos atnaujinimo, modernizavimo ir paprastinimo programa. Praėjus ketveriems metams galima matyti įtikinamus rezultatus. Paprastinimas, kuriam anksčiau buvo būdinga daug atskirų veiksmų, tapo neatsiejama bet kurios politikos peržiūros dalimi visose politikos srityse. Tai aiškiai rodo acquis peržiūra, kurios rezultatai pateikti kartu su šia ataskaita.

Ši trečioji reglamentavimo aplinkos paprastinimo strategijos pažangos ataskaita papildo trečiąją Geresnio reglamentavimo Europos Sąjungoje strateginę apžvalgą [3] ir Komisijos darbinio dokumento dėl administracinės naštos mažinimo pažangos ataskaitą. Joje apžvelgta daugybė nuo strategijos parengimo pradžios nagrinėtų sričių, pateikti geriausi pavyzdžiai ir nustatytos būsimos paprastinimo veiklos sritys.

2. Esama padėtis

Naudodamasi įvairiomis konsultavimo priemonėmis Komisija nuolat gauna ir nagrinėja piliečių, suinteresuotųjų šalių ir valstybių narių pasiūlymus Bendrijos teisės aktus padaryti aiškesnius, paprastesnius ir veiksmingesnius.

Remdamasi šiais pasiūlymais Komisija parengė tęstinę paprastinimo programą, kurią sudarė 100 paprastinimo iniciatyvų 2005–2008 m. laikotarpiui. Programoje taikomos visos paprastinimo strategijoje nustatytos priemonės – teisės aktų leidybos metodai, visų pirma panaikinimas, kodifikavimas ir išdėstymas nauja redakcija, bei kitos acquis modernizavimo priemonės, kaip antai platesnis informacinių technologijų priemonių naudojimas.

Nuo 2007 m. paprastinimo programa įtraukta į Komisijos teisėkūros ir darbo programą. Ji kasmet papildoma naujomis iniciatyvomis ir šiuo metu apima visas politikos sritis. Dabar joje yra 185 iniciatyvos, iš kurių maždaug 132 Komisija priėmė 2007–2008 m. (apie 80 %). Tai rodo Komisijos ryžtą įveikti visas kliūtis ir laiku parodyti šios prioritetinės veiklos teikiamą naudą. Šiuo metu baigtas daugiau nei pusės patvirtintų iniciatyvų teisėkūros procesas, jos paskelbtos Oficialiajame leidinyje ir yra tapusios teisės aktais.

Komisija įgyvendinama 2005–2009 m. paprastinimo programa jau pateikė pasiūlymų iš dalies keisti arba panaikinti apie 800 teisinių aktų. Priėmus šiuos pasiūlymus acquis sumažės maždaug 600 teisės aktų arba apie 6 500 Oficialiojo leidinio puslapių, bet tai ne viskas. Paprastinimo veikla tapo neatskiriama bet kurios politikos srities persvarstymo dalis. Be to, Komisija toliau kodifikuoja acquis siekdama jį padaryti glaustesnį ir lengviau skaitomą nepanaikinant jo teisinio tikrumo. Komisija kodifikavo jau 229 teisės aktus. 142 iš šių teisės aktų jau yra priimti institucijų, priimančių teisės aktus, ir jais panaikinti 729 ankstesni teisės aktai (tai sudaro apie 1 300 Oficialiojo leidinio puslapių).

Iš viso dabartinė Komisija nuo 2005 m. spalio mėn. acquis sumažino beveik 10 % – apie 1 300 teisės aktų ir 7 800 Oficialiojo leidinio puslapių.

3. rezultatai

Iki šiol baigtas apie 75 iš minėtų 132 paprastinimo iniciatyvų teisėkūros procesas – 36 priimtos Komisijos kaip autonominio pobūdžio teisės aktai (4 priedas) ir 39 – teisės aktų leidėjo (5 priedas).

Šių ir kitų paprastinimo priemonių teikiama nauda bendrovėms, gyventojams ir valdžios institucijoms tampa vis labiau apčiuopiama. Tolesniuose skirsniuose pateikti kai kurie pavyzdžiai, kuriuose apžvelgiami skirtingi papildomi paprastinimo būdai.

3.1. Paprastesnė reglamentavimo sistema

Ilgainiui teisės aktai keičiasi, nes prie teisinio pagrindo pridedami nauji elementai. Tam, kad būtų užtikrinta jų darna ir jie sudarytų nuoseklią sistemą, Komisija nuolat persvarsto galiojančius teisės aktus ir ieško efektyvesnių bei veiksmingesnių teisinių sprendimų.

· Nauju Bendruoju bendrosios išimties reglamentu valstybėms narėms leista tvirtinti tam tikras pagalbos priemones prieš tai iš anksto nepranešus Komisijai – taip pagreitinamas atvejų nagrinėjimas. Reglamentas, kuriuo siekiama skatinti darbo vietų kūrimą ir konkurencingumą, apima pagalbą MVĮ, moksliniams tyrimams, inovacijoms, regioninei plėtrai, mokymui, užimtumui ir rizikos kapitalui. Pavyzdžiui, bendrovėms gali būti skiriama pagalba fundamentiniams tyrimams (iki 100 %), pramoniniams tyrimams (iki 50–70 %) ir bandomajai taikomajai veiklai (25–45 %). Juo taip pat suderinti ir į vieną tekstą sujungti penki teisės aktai.

· Naujosiose tiesioginių išmokų ūkininkams kontrolės taisyklėse numatyta paprastesnė ir efektyvesnė kontrolinės imties atrankos, kontrolės vykdymo laiku ir patikrinimų vietoje procedūrų sistema [4].

· Naujajame Reglamente dėl verslo struktūros statistikos sumažinta informacijos reikalavimų ir numatyta duomenis rinkti vieną, o ne kelis kartus per metus. Taip pat pateiktas naujas statistinis Europos bendrijos ekonominės veiklos rūšių klasifikatorius. Manoma, kad duomenų, kuriuos reikia pateikti, kiekis taip bus bendrai sumažintas 17,5 %.

· Pagal Oro taršos ir atliekų prevencijos ir perdirbimo temines strategijas supaprastinti ir aiškiau išdėstyti pagrindiniai šių sričių teisės aktai. Naująja aplinkos oro kokybės direktyva sujungtos 5 skirtingos direktyvos, o naująja Pagrindų direktyva dėl atliekų – direktyvos dėl pavojingų atliekų ir alyvų atliekų.

· Naujojoje Vandens pagrindų direktyvoje numatyta bendra nuosekli politikos planavimo, įgyvendinimo ir ataskaitų teikimo programa, skirta švariam vandeniui visoje Europoje išsaugoti ir atkurti, ja sumažintas vandens sektoriaus direktyvų skaičius (nuo 18 iki 10).

· Nauja Sveikatos ir saugos darbe direktyva supaprastintos ir racionalizuotos valstybių narių teikiamos pagrindų direktyvos ir jos atskirų direktyvų praktinio įgyvendinimo ataskaitos. Nuo šiol valstybės narės ataskaitas turės teikti tik kas 5 metus.

3.2. Geresni darbo metodai ir supaprastintos procedūros

Komisija aktyviai skatina platesnį informacinių technologijų taikymą kaip būdą darbo tvarkai gerinti.

· Naudojant naująjį Bendrą viešųjų pirkimų žodyną (standartinį ES produktų aprašymą) lengviau nustatyti viešųjų pirkimų galimybes visoje ES nepriklausomai nuo viešųjų pirkimų šalies kalbos. Standartizuotos ir automatizuotos viešųjų institucijų naudojamos formos pranešimams Europos Sąjungos oficialiajame leidinyje skelbti, taip sumažinant leidybos laiką nuo 12 iki 5 dienų. Abu pokyčiai padės viešųjų pirkimų rinkas padaryti skaidresnes. ES svetainėje „Tenders Electronic Daily“ (TED) kasdien skelbiamos 1 mlrd. EUR vertės viešojo sektoriaus verslo galimybės.

· Bendrovės muitinės kodekso paprastinimas susijęs su ES muitų teisės aktų modernizavimu ir kompiuterizuotos muitinės ir prekybos aplinkos kūrimu. Elektroninis muitinės deklaracijų ir kartu pateikiamų dokumentų registravimas taps privalomas. Leidimus gavę prekiautojai prekes galės deklaruoti elektroniniu būdu ir mokėti muitus valstybėje narėje, kurioje yra įsisteigę, nepriklausomai nuo to, kur ES muitų teritorijoje prekės buvo atvežtos arba iš kur išvežtos ir kur jos bus vartojamos ar naudojamos. Apskaičiuota, kad pradėjus visiškai veikti integruotai sistemai, prekybininkai kasmet turėtų sutaupyti 2,5 mlrd. EUR.

· Iš dalies pakeitus Bendrojo reglamento dėl sanglaudos politikos 55 straipsnį, supaprastintos taisyklės mažiems projektams, iš kurių gaunamos pajamos. Nuostata, pagal kurią smulkių veiksmų (kurių bendrosios išlaidos nesiekia 200 000 EUR) priežiūrai taikomas proporcingumo principas, pakeista taip, kad šis straipsnis netaikomas Europos socialinio fondo ir Europos regioninės plėtros fondo arba Sanglaudos fondo bendrai finansuojamiems veiksmams, kurių bendrosios išlaidos nesiekia 1 mln. EUR.

3.3. Tinkamai veikianti vidaus rinka

Vidaus rinka buvo ir tebėra paprastinimo ES varomoji jėga, leidžianti daugybę nacionalinių įstatymų sujungti į vieną teisės aktą.

· Oro susisiekimo paslaugų teikimo Bendrijoje bendrosiose taisyklėse persvarstytas vadinamasis oro transporto liberalizavimo nuostatų trečiasis paketas. Tai turėtų padidinti vartotojų pasirinkimo galimybes, sumažinti mokesčius ir skatinti konkurenciją. Be to, taikant griežtesnius reikalavimus įsteigtoms oro transporto bendrovėms ir geriau jas prižiūrint bus sumažinta jų bankroto rizika ir neigiamos pasekmės keleiviams. Vidutinės metinės išlaidos bankroto atvejais keleiviams, įskaitant sugrįžimo išlaidas ir su išankstiniu užsisakymu susijusius nuostolius, yra apie 15,6 mln. EUR. Ne ilgiau kaip dvejus metus veikiančių oro vežėjų bankrotų skaičių sumažinus 50 %, klientai kasmet vidutiniškai sutaupytų 2,4 mln. EUR.

· Persvarstyta Direktyva dėl geležinkelių sistemos sąveikos Bendrijoje atnaujinamos transporto priemonių sertifikavimo taisyklės. Apskaičiuota, kad taupant sertifikavimo išlaidas, per ateinančius 15 metų geležinkelio bendrovės ir gamintojai sutaupytų 200–280 mln. EUR.

· Naujuoju Reglamentu dėl didžiausios leidžiamosios pesticidų koncentracijos (DLK) maiste ir pašaruose apie 500 000 nacionalinių DLK pakeista 100 000 ES DLK – tai naudinga ūkinės veiklos vykdytojams, kuriems nebereikia teikti kelių paraiškų skirtingose valstybėse narėse.

· PVM pakete pateiktos naujos paslaugų taisyklės, pagal kurias verslo verslui teikiamos paslaugos bus apmokestinamos kliento valstybėje narėje. Tai turėtų paskatinti bendroves teikti paslaugas visoje Bendrijoje. Į paketą taip pat įtraukta „mini vieno langelio schema“, skirta ES įsisteigusioms telekomunikacijų, transliacijos ir elektroninės prekybos paslaugų bendrovėms, ir nauja PVM grąžinimo tvarka valstybėje narėje, kurioje nustatytas PVM, neįsisteigusioms bendrovėms.

· Bendrovių teisės srityje 2007 m. paspartinta tvarka priimta direktyva dėl bendrovių sujungimo ir skaidymo supaprastinti tarpvalstybiniai sujungimai, todėl akcinės bendrovės sutaupo 17 mln. EUR.

4. Daugiau rezultatų. Svarstomi pasiūlymai ir tarpinstituciniai aspektai

Nuo 2008 m. sausio mėn. iki 2009 m. sausio mėn. padaugėjo Tarybos ir Europos Parlamento priimtų paprastinimo priemonių – nuo 16 iki 39. Tačiau Taryba ir Europos Parlamentas dar nepriėmė 50 pasiūlymų dėl paprastinimo (3 priedas). Svarbu, kad institucijos šiuos pasiūlymus apsvarstytų greičiau ir bendrovės, piliečiai bei viešojo administravimo institucijos galėtų naudotis jų privalumais.

· Priėmus naująją ES direktyvą dėl investicijų fondų, vadinamąją KIPVPS (kolektyvinio investavimo į perleidžiamuosius vertybinius popierius subjektai) direktyvą, vartotojai galės naudotis profesionaliomis investicijų valdymo paslaugomis prieinamomis sąlygomis, KIPVPS valdytojai galės plėtoti tarpvalstybinę veiklą, konsoliduoti santaupas ir kurti masto ekonomijas, investuotojai turės naudos galėdami rinktis iš daugiau mažesnėmis sąnaudomis veikiančių investicijų fondų, o į KIPVPS investuojantys mažmeniniai investuotojai bus apsaugoti užtikrinant jiems aiškios, lengvai suprantamos ir būtinos informacijos gavimą. Direktyva bus pakeista 10 galiojančių direktyvų.

· Pateikta keletas svarbių pasiūlymų bendrovių teisės srityje siekiant supaprastinti veiklos vykdymą ES ir daug sutaupyti. Tarp šių priemonių yra Tarybos reglamento dėl Europos privačiosios bendrovės statuto pasiūlymas, pasiūlymas sumažinti bendrovėms taikomus reikalavimus versti ir skelbti informaciją, taip sutaupant apie 600 mln. EUR, ir pasiūlymas dėl atskaitomybės ir dokumentų teikimo reikalavimų sujungiant ir skaidant bendroves.

· Naujuoju kosmetikos reglamentu bus panaikinta per 3 500 puslapių teisinio teksto. Nors priėmus pasiūlymą bendrovių išlaidos sumažės mažiausiai 50 %, saugumo standartų lygis išliks toks pat aukštas. Aiškiau išdėstytos gaminių saugos vertinimo procedūros ir supaprastintos pranešimo apie naujus kosmetikos gaminius taisyklės. Tai turės didelės įtakos, nes Europos kosmetikos gaminių rinkos vertė yra apie 65 mlrd. EUR ir joje tiesiogiai bei netiesiogiai sukuriama per 350 000 darbo vietų.

· Peržiūrėjus vaistų reglamentus dėl pakeitimų bus suderinti keitimų vertinimo kriterijai ir persvarstymo bei patvirtinimo laikotarpiai. Duomenys rodo, kad tipiška nepatentuotus vaistus gaminanti bendrovė kasmet turi tvarkyti per 1 500 vaistų pakeitimų, o didesnė vaistų bendrovė – daugiau kaip 12 000. Pasiūlymu bus padidintas bendrovių konkurencingumas sumažinant logistinių problemų, kaip antai susijusių su skirtingų to paties produkto versijų tiekimu skirtingoms nacionalinėms rinkoms. Supaprastinus sistemą bendrovėms, ypač MVĮ, bus lengviau plėsti veiklą kitose ES rinkose.

· Naujuoju pasiūlymu dėl automobilių saugumo paketo bus panaikinta 150 direktyvų dėl transporto priemonių tipo patvirtinimo ir supaprastinta dabartinė reglamentavimo sistema bei nustatytas privalomas saugos elementų ir padangų slėgio stebėjimo sistemų įdiegimas lengvuosiuose automobiliuose – tai itin pagerintų transporto priemonių saugumą ir sumažintų išmetamo CO2 kiekį.

· Direktyva dėl vartotojų teisių bus pagerintas bendrovių ir vartotojų vidaus rinkos veikimas ir sumažintas bendrovių nenoras prekiauti kitose šalyse. Ja bus sumažintas dabartinės reglamentavimo sistemos susiskaidymas – bus panaikintos 4 direktyvos. Direktyva bus sugriežtinta reglamentavimo sistema, o standartizuotos su vartotojais pasirašomų sutarčių sąlygos smarkiai sumažins sąnaudas, patiriamas dėl nuostatų laikymosi.

· Pasiūlymų dėl efektyvaus energijos vartojimo paketo tikslas – energijos taupymas svarbiausiose srityse, pavyzdžiui, griežtinant pastatams ir energiją naudojantiems produktams taikomus efektyvesnio energijos vartojimo teisės aktus. Taupiai energiją naudojantis namų ūkis kasmet gali nesunkiai sutaupyti per 1 000 EUR.

· Kalbant apie Bendrijos prekybos prekėmis statistikos (Intrastat) sritį, pagal Europos teisės aktuose nustatytus duomenų teikimo ribinius dydžius prievolė teikti duomenis nebus taikoma 370 000 bendrovių. Taigi per 6 metus apklausiamų bendrovių skaičius apytikriai sumažės 52 % (nuo 720 000 2004 m. iki 350 000 2010 m.).

· Pasiūlymo dėl pašarų pateikimo rinkai ir jų naudojimo tikslas – skatinti bendroves diegti daugiau naujovių ir stiprinti jų konkurenciją. Naujuoju reglamentu bus panaikintos 7 direktyvos (nuo daugiau kaip 100 puslapių iki maždaug 30). Taip pat bus panaikintas draudžiamasis leidimo išdavimo prieš patenkant į rinką tam tikriems produktams (bioproteinams) reikalavimas (nes jis neproporcingas pavojui). Kalbant apie sąnaudų mažinimą, apskaičiuota, kad pramonės įmonės bendras su nauju bioproteinų leidimu susijusias išlaidas sumažintų 481 000 EUR.

· Pasiūlymu dėl naujos Direktyvos dėl taršos integruotos prevencijos ir kontrolės (TIPK) redakcijos į vieną teisės aktą bus sujungtos 7 direktyvos dėl pramoninės taršos. Juo būtų panaikintos pasenusios galiojančių direktyvų dalys, supaprastinti leidimo išdavimo reikalavimai, sumažinta ūkinės veiklos vykdytojų atskaitomybė ir supaprastinta valstybių narių atskaitomybė. Šiuo pasiūlymu bus itin sumažintos administracinės išlaidos (apytikriai apskaičiuota, kad 32 mln. EUR per metus), netgi itin sumažintos valstybių narių (nacionalinės arba regionų) administracinės išlaidos (150–300 mln. EUR per metus).

· GSM paketo tikslas – suteikti daugiau galimybių naujovėms naudoti 900 ir 1800 MHz spektrą (GSM dažnių juostas). Šiuo paketu bus panaikintos ribojamosios nuostatos, neatitinkančios technologijų plėtros ir trukdančios plačiai naudotis plačiajuosčio judriojo ryšio paslaugomis.

· Bendros žemės ūkio politikos būklės patikros programa bus supaprastinta bendrosios išmokos schema. Visų pirma tai reiškia, kad bus stengiamasi atsisakyti dviejų lygiagrečių susietos ir atsietos paramos sistemų, ir dar labiau jas atskirti. Manoma, kad atskyrus šias sistemas vien tik Jungtinės Karalystės ūkininkams tenkanti administracinė našta sumažėtų 0,63 mln. EUR. Šiuo supaprastinimu taip pat panaikinamas 10 % atidėtos žemės reikalavimas. Ūkininkai gali naudoti visą žemę, jiems nebereikia atlikti susijusių procedūrų, o valstybės narės daugiau neturi kontroliuoti šios priemonės. Kalbant apie naudą, manoma, kad dėl to vien tik Anglijoje ūkininkams tenkanti administracinė našta sumažėtų 4,4 mln. EUR [5].

· Visos su žvejybos veikla susijusios nuostatos bus įtrauktos į bendrą reglamentavimo sistemą itin pabrėžiant šiuolaikinių technologijų naudojimą ir sąsajas su duomenų bazėmis.

· Telekomunikacijų teisės aktų paketo reforma bus sumažintos pramonei tenkančios administracinės išlaidos, nes sumažės rinkų, kurias gali lengvai paveikti ex ante konkurencijos reguliavimas, skaičius ir bus supaprastintos rinkos peržiūros procedūros, įkuriant Europos reguliavimo instituciją ir reformuojant spektro valdymą. Elektroninių ryšių paslaugos ir infrastruktūra suteikia pagrindus ekonomikai apskritai, o pagerinus šio sektoriaus veikimą, naudos turės visa ES.

· Pasiūlymo pagerinti regioninės politikos programų įgyvendinimą tikslas – palengvinti finansinį valdymą ir pagreitinti veiklos programoms ir projektams būtinų Bendrijos finansinių išteklių skyrimo procedūrą. Visų pirma Komisija pasiūlė, kad pridėtinės projektų išlaidos būtų kompensuojamos skiriant vienkartines išmokas, o gavėjams teikiamus valstybės pagalbos išankstinius mokėjimus valdžios institucijoms galėtų visiškai kompensuoti ES. Šie pakeitimai bus itin naudingi MVĮ.

· Modernizavus nacionalinių socialinės apsaugos sistemų koordinavimą bus sudarytos palankesnės sąlygos laisvam darbuotojų ir jų šeimų judėjimui visoje ES. Tai taip pat bus naudinga 173 mln. Europos sveikatos draudimo kortelės turėtojams, kurie trumpai viešėdami bet kurioje valstybėje narėje gali naudotis sveikatos priežiūros paslaugomis taip, kaip ir tos valstybės piliečiai.

Tarybos ir Europos Parlamento svarstomų pasiūlymų daugėja. Todėl būtina, kad būtų išnagrinėtos greitesnio jų priėmimo priemonės ir įdėtos visos pastangos sutarimui pasiekti – jei įmanoma, per pirmąjį svarstymą, kai taikoma bendro sprendimo procedūrą. Komisija pritaria Europos Parlamento iniciatyvai kurti specialias struktūras paprastinimui skatinti, kaip teigiama neseniai priimtoje M. Ortegos ataskaitoje.

Europos Parlamentas patvirtino pageidaujantis, kad Komisija kaip įprastą teisės aktų leidybos metodą naudotų teisės aktų išdėstymą nauja redakcija, net kai siūloma persvarstyti galiojančius tekstus. Tačiau svarbu, kad Taryba ir Europos Parlamentas laikytųsi paprastinimo veiklos principų ir idėjos kuo labiau išlaikydami priimtų pasiūlymų paprastumą ir pagreitindami sprendimų priėmimo procesą, kas būtų naudinga verslui, piliečiams ir viešojo administravimo institucijoms.

5. Kodifikavimas

Komisija teisės aktus ne tik paprastina, bet taip pat juos kodifikuoja, t. y. į vieną tekstą sujungia pagrindinį įstatymą ir visus tolesnius pakeitimus. Taip teisės aktai tampa aiškesni ir sumažėja Bendrijos acquis apimtis.

Iki šiol Komisija iš viso kodifikavo 229 teisės aktus. 142 iš šių aktų kodifikuoti, priimti ir paskelbti Oficialiajame leidinyje (102 Komisijos aktai ir 40 Europos Parlamento bei Tarybos aktų). Šie 142 kodifikuoti teisės aktai pakeitė 729 ankstesnius aktus, sudarančius maždaug 1 300 Oficialiojo leidinio puslapių.

Taryboje ir Europos Parlamente dar svarstomi 87 teisės aktai.

Panaikinta dauguma kodifikavimui skirtų į naujųjų valstybių narių kalbas neišverstų teisės aktų. Kiti pasiūlymai dėl 2006 m. persvarstytos kodifikavimo programos užbaigimo bus pateikti 2009 m. kartu su ataskaita, kurioje bus išsamiai nurodyti bendri programos rezultatai. 2009 m. kodifikavimui atrinktas 21 naujas teisės aktas (6 priedas).

6. Tolesni žingsniai

6.1. 2009 m. ruošiamos iniciatyvos

Į 2009 m. teisėkūros ir darbo programą [6] Komisija įtraukė 33 paprastinimo iniciatyvas (7 priedas).

Pavyzdžiui:

· Persvarstyta Direktyva 2000/35/EB dėl kovos su pavėluotu mokėjimu komerciniuose sandoriuose valdžios institucijos ir bendrovės bus skatinamos nevėluoti sumokėti tiekėjams, o kreditoriai – siekti žalos atlyginimo už pavėluotus mokėjimus. Ši iniciatyva – Europos smulkiojo verslo akto ir Europos ekonomikos atkūrimo plano dalis.

· EB teisės aktų, kuriais reglamentuojami žemės ir miškų ūkio traktorių tipai, supaprastinimas – 24 direktyvų pakeitimas vienu reglamentu.

· Reglamento (EB) Nr. 44/2001 pakeitimas ir modernizavimas, kad šis reglamentas būtų pritaikytas prie naujų tarptautinių teisės aktų ir užtikrintas sprendimų civilinėse ir komercinėse bylose pripažinimas ir vykdymas, palaipsniui panaikinant tarpinius formalumus (exequatur), kuriuos piliečiai turi atlikti, kad teismo sprendimas būtų pripažintas ir vykdomas užsienyje.

· Bendro žuvininkystės ir akvakultūros sektoriaus rinkų organizavimo reforma daugiausia dėmesio skiriant tvariai žvejybai ir prekybai. Ši reforma apima prisitaikymą prie rinkos pokyčių, darnos su kitais Bendros žuvininkystės politikos elementais ir susijusiomis Bendrijos politikos sritimis (prekyba, sveikata ir vartotojų apsauga, aplinka) stiprinimą, be to, ji paskatins platesnį elektroninių priemonių naudojimą.

Be to, Komisija ir toliau dirba su valstybėmis narėmis ieškodama daugiau sanglaudos politiką reglamentuojančių nuostatų paprastinimo ir naudos gavėjams tenkančios administracinės naštos mažinimo būdų.

6.2. Acquis peržiūra ir tolesni paprastinimo veiksmai

Kaip paskelbta antrojoje Geresnio reglamentavimo ES strateginėje apžvalgoje, Komisija išsamiai peržiūrėjo acquis.

Pirmiausia atlikta sisteminga acquis peržiūra siekiant nustatyti svarbiausias reglamentavimo priemones. Atlikus šią peržiūrą atrinkta apie 3 600 teisės aktų, kurie peržiūrėti išsamiau siekiant nustatyti, ar šie teisės aktai nėra pasenę ir ar juos galima supaprastinti.

Siekiant pateikti naujausią išsamią informaciją apie Komisijos pastangas supaprastinti acquis, svetainėje „Europa“ [7] bus skelbiami išsamūs kiekvienos politikos srities paprastinimo rezultatai.

Peržiūros rezultatai rodo:

· kiek teisės aktų jau supaprastinta;

· kiek teisės aktų ketinama supaprastinti 2009 m.;

· kiek teisės aktų reikės supaprastinti kitai Komisijai arba

· kiek teisės aktų neplanuojama supaprastinti, nes tekstas yra aiškus, nepasenęs ir proporcingas politikos tikslams. Kai kuriais iš šių atvejų teisės aktų pakeitimai galėtų būti naudingi, tačiau bendrovės ir viešojo administravimo institucijos patirtų daug išlaidų ir joms tektų didelė našta, ypač perkeliant juos į nacionalinę teisę.

Esama padėtis rodo didelę pažangą. Apie du trečdaliai teisės aktų, pirmiausia žemės ūkio, vidaus rinkos, transporto, įmonių, sveikatos ir aplinkos sričių, supaprastinti pagal tęstinę paprastinimo programą, kodifikavimo programą ar kitas Komisijos iniciatyvas, arba šiuo metu yra numatyti supaprastinti 2009 m. (2 priedas).

Šia apžvalga taip pat galima pagrįsti tolesnį paprastinimą. Nagrinėdama galiojančius teisės aktus ir atsižvelgdama į jais reglamentuojamus sektorius, Komisija žengia integruoto požiūrio į paprastinimą link. Į būsimas paprastinimo iniciatyvas galėtų būti įtrauktas dar 81 veiksmas (1 priedas).

Pavyzdžiui:

· 15 techninio derinimo direktyvų suderinimas su sprendimu, kuriuo nustatoma bendroji gaminių prekybos sistema. Jame nustatyti veiksniai, kurie dažniausiai naudojami standartinės formos techninio derinimo teisės aktuose ir kurie turėtų būti įtraukti į būsimus teisės aktus. Pagrindinis tikslas – užtikrinti darnesnę teisinę aplinką ir kurti bendrą teisėkūros kultūrą. Tai pagerins teisės aktų kokybę ir sumažins administracinę naštą.

· Bendros žemės ūkio politikos įgyvendinimo taisyklių supaprastinimas patvirtinus BŽŪP patikrinimą dėl intervencijos valdymo mechanizmo.

· Teisės aktų dėl grėsmių sveikatai (užkrečiamų ligų ir cheminių, biologinių bei radiologinių ir branduolinių grėsmių) ir gyvūnų sveikatos, gerovės ir pašarų persvarstymas.

· Tolesnis naštos mažinimas statistikos srityje taikant Europos įmonių ir prekybos statistikos modernizavimo (MEETS) programą. Bus pagerinti duomenų rinkimo valstybėse narėse metodai naudojant daugiau administracinių ir apskaitos duomenų bei geresnes atrankos sistemas ir geriau bei intensyviau naudojant turimus šaltinius.

7. Baigiamosios pastabos

Paprastinimo veikla į Komisijos darbą įtraukta 2005 m., kuomet buvo parengta reglamentavimo aplinkos paprastinimo strategija. Imdamasi įvairių suderintų veiksmų Komisija parengė politinę ir praktinę veiksmų, teikiančių apčiuopiamos naudos gyventojams, bendrovėms ir viešojo administravimo institucijoms, programą. Siekiant teisės aktus padaryti aiškesnius ir labiau suprantamus pasiūlyta panaikinti apie 1 300 ES teisės aktų, sudarančių apie 10 % acquis.

Paprastinimas yra tęstinis procesas. Acquis peržiūra – pagrindas tolesniam darbui. Programa, kurią iš pradžių sudarė keletas išmėtytų iniciatyvų, dabar apima visas politikos sritis ir ji vis labiau orientuojama į atskirus sektorius. Tai reiškia visų teisės aktų, turinčių įtakos susijusiai politinei sričiai, nagrinėjimą siekiant nustatyti sutapimus, spragas, nesuderinamumą ir pernelyg didelę reglamentavimo naštą. Siekiama įvertinti bendrą kiekvieno sektoriaus reglamentavimo sistemos veiksmingumą.

Įgyvendinant paprastinimo darbotvarkę Komisijai reikės politinės kitų ES institucijų ir valstybių narių paramos. Europos Parlamento ir Tarybos prašoma dėti visas įmanomas pastangas, kad kuo greičiau būtų priimti svarstomi pasiūlymai ir priimant sprendimus išlaikyta tuose pasiūlymuose numatyto paprastinimo tikslo esmė. Valstybės narės raginamos toliau vykdyti savo paprastinimo programas ir ES teisės aktus taikyti atsižvelgiant į paprastinimo tendenciją, nepriimant papildomų nereikalingų priemonių.

Europos piliečiai ir bendrovės kasdien susiduria su įvairiais ES, nacionaliniais ir regioniniais teisės aktais. Tik koordinuotos paprastinimo pastangos visais šiais lygmenimis gali padėti užtikrinti, kad ši reglamentavimo sistema būtų taikoma kaip įmanoma labiau pagal paskirtį – užtikrinant augimą ir gerovę bei kuo labiau sumažinant naštą.

12. | Community initiative on work-related musculoskeletal disorders | Recast | Follow-up of the second phase of consultation of the social partners. The objective of this initiative is to integrate into a single legislative instrument the provisions on the protection of the health and safety of workers from the risks of musculo-skeletal disorders at work. These provisions are currently fragmented over different directives, namely Council Directive 90/269/EEC and Council Directive 90/270/EEC. A single legislative instrument would be more comprehensive, clearer and easier to apply. It will benefit employers in terms of legal clarity and workers in terms of providing better protection against the risks of musculo-skeletal disorders. |

13. | Revision of Directive 2000/35 of the European Parliament and Council on combating late payment in commercial transactions | Revision | Several key provisions of the current Directive are unclear or difficult to implement, thereby creating various hurdles for businesses to claim their rights in case of late payment. The overall objective is to discourage debtors from paying late and to provide creditors with measures that enable them to fully exercise all their rights when paid late. The simplification would entail a clarification of the calculation of the applicable interest rate, a better description of the nature and extent of “retention of title”, a new definition of the types of commercial transactions covered by the Directive and a clearer definition of “relevant recovery costs” to include internal administrative costs linked to late payment. |

14. | Regulation relating to the type-approval of agricultural and forestry vehicles | Recast | The proposal will simplify EC legislation on agricultural and forestry tractors by replacing existing legislation (including the present Framework Directive and the separate Directives) by one main Regulation. 20. | Amendment to Regulation 44/2001 concerning jurisdiction, recognition and enforcement of judgments in civil and commercial matters | Revision | The objective is to ensure free circulation of all judgments in the EU by the abolition of exequatur and to adapt the provisions of the Regulation to the new international instruments in the area concerned. It will also abolish intermediary steps which citizens have to go through in order to have a judicial decision recognised and enforced abroad. |

21. | Council Regulation on the reform of the common organisation of the markets in fishery and aquaculture products | Revision | The common market organisation (CMO) was created to achieve the objectives laid down in Article 33 of the Treaty in the fishery sector, in particular to provide market stability and to guarantee a fair income for producers. More recent objectives focus on sustainability-supportive fishing and marketing activities. In place since 1971, the common market organisation has undergone many changes over time, and a reshaped CMO has been in operation since 1 January 2001. The effectiveness and efficiency of this policy is currently being evaluated. The proposal aims at taking account of market developments, changes in fishing activities and the shortcomings detected in the implementation of the provisions currently in force. |

22. | Commission implementation rules on the reformed control and enforcement framework | Revision | The new rules will modernize and simplify procedures for national administrations and stakeholders and will facilitate better enforcement. Administrative burden and constraints for the sector and public administrations are to be alleviated, with an increased use of IT tools to reduce reporting obligations. All aspects related to control and monitoring of fisheries activities (declaration of catches, tolerance margins, landing declarations, transport, localisation of the fleet, etc.) will be simplified. Also new elements to address the challenges of Illegal, Unreported and Unregulated (IUU) fishing will be included. |

23. | Commission Communication on formal recognition of obsolescence and four proposals repealing obsolete legal instruments in the field of the Common Fisheries Policy | Repeal | Screening of the body of Community law relating to the Common Fisheries Policy (CFP) within the context of the "2006-2008 Action Plan for simplifying and improving the CFP" revealed that a number of Acts of Community law have exhausted their legal effects, though they have not been formally repealed or have no indication of a time limit as to their validity. To repeal acts still in force, the same enabling power should be used as that for the initial act. 24. | Recast of Decisions relating to checks on insurance against civil liability in respect of the use of motor vehicles | Recast | Over the past few years, the Commission has adopted a number of Decisions (2003/542/EC, 2004/332/EC, 2005/849/EC, and 2007/482/EC) on the abolition of insurance checks in respect of the countries acceding to the EU. The Recast aims at simplifying and clarifying the regime of these Decisions adopted under Article 2 of Directive 72/166/EC on motor insurance. |

25. | Recast of the Prospectus Directive | Recast | Areas where legislative changes are required to improve and simplify the application of the directive will be identified in order to reduce the administrative burden on issuers, without lowering the standard of investors' protection. This will lead to improved readability and hence enable better and harmonised implementation in MSs thus potentially reducing administrative burdens. 32. | Marine Equipment Directive | Recast | Directive 96/98/EC has been technically amended three times since its adoption and a further two technical amendments are currently under preparation (respectively concerning the committee procedure and the technical annexes). Furthermore, the new legislative framework for the marketing of products will have a direct impact on a number of basic elements (notified bodies, market surveillance, and safeguard clause). Lastly, the current system of periodical technical updates is in need of an in-depth revision in order to keep pace with the legislative production of the International Maritime Organisation. It is intended to recast or to repeal the existing Directive and replace it with a new one. |

33. | Recast of the Community regulatory framework regarding transport of radioactive material | Recast | At Community level there are currently more than 30 directives, regulations and recommendations governing the transport of radioactive material. There are also non-binding international rules. Inconsistent transposition of these rules means that there is an unnecessary degree of complexity causing practical problems on the ground in Member States, including increased costs and delays. Simplification of rules and procedures would reduce this and an initial estimate puts the potential at a reduction of 50% in the labour costs and 30% in the costs to operators. |
