Introduzzjoni L-Artikolu 14 tar-Regolament tal-Kunsill (KE) Nru 2371/2002[1] u l-Artikolu 12 tar-Regolament tal-Kummissjoni (KE) Nru 1438/2003[2] jirrikjedu li l-Istati Membri jibagħtu lill-Kummissjoni, qabel l-1 ta’ Mejju ta’ kull sena, rapport dwar l-isforzi tagħhom tas-sena ta' qabel sabiex jinkiseb bilanċ sostenibbli bejn il-kapaċità tal-flotta u l-opportunitajiet ta' sajd disponibbli. Ir-rapporti ta' l-Istati Membri jinsabu fuq il-website "Europa"[3]. Abbażi ta’ dawn ir-rapporti u d- data li tinsab fir-Reġistru tal-Flotta tas-Sajd tal-Komunità[4] il-Kummissjoni fasslet sommarju għas-sena 2005 li ġie ppreżentat lill-‘Kumitat Xjentifiku Tekniku u Ekonomiku tas-Sajd’ (STECF) u l-‘Kumitat għas-Sajd u l-Akwakultura’. F’dan ir-rapport il-Kummissjoni issa tippreżenta dak is-sommarju, flimkien mal-fehmiet tal-kumitati msemmija hawn fuq, lill-Kunsill u lill-Parlament Ewropew. Dan ir-rapport għandu żewġ partijiet: - l-ewwel parti tiddeskrivi r-regoli li l-Istati Membri jridu jsegwu fil-ġestjoni tal-flotot tagħhom u tagħti fil-qosor l-informazzjoni mressqa skond Artikolu 13 tar-Regolament tal-Kummissjoni (KE) Nru 1438/2003 dwar ir-regoli ta’ implimentazzjoni dwar il-politika dwar il-flotot; - it-tieni parti turi l-iżvilupp tal-kapaċitajiet tal-flotot ta’ l-Istati Membri fl-2005 f’forma ta’ tabelli numeriċi li fihom l-informazzjoni rilevanti dwar il-ġestjoni taż-żieda u t-tneħħija tal-bastimenti f’kull flotta nazzjonali. 2. IL-ĠESTJONI TAL-FLOTOT FIL-POLITIKA KOMUNI TAS-SAJD RIFORMATA Skond il-Politika Komuni dwar is-Sajd (PKS) adottata f’Diċembru 2002, il-flotot tas-sajd jitmexxew skond ir-regola ġenerali li kapaċità ġdida, imfissra f’tunnellaġġ u qawwa, li tiddaħħal fil-flotta ma tistax tkun ogħla minn dik li tneħħiet minnha (ara l-Anness Tekniku 1). 3. SINTEżI TAR-RAPPORTI ANNWALI TA’ L-ISTATI MEMBRI Din is-sena, għal darb' oħra, kienu biss għaxar Stati Membri li bagħtu r-rapporti annwali tagħhom qabel id-data ta' skadenza tat-30 t'April 2006; ir-rapporti li kien għad fadal ddewmu (pereżempju, l-Italja jew Franza ressqu r-rapporti tagħhom xhur wara d-data ta' skadenza). Ir-Renju Unit ma bagħatx rapport annwali. Barra minn hekk, l-informazzjoni inkluża fir-rapporti ta' l-Istati Membri mhix omoġenea u xi kultant il-format/kontenut tar-rapporti annwali ma ġiex rispettat. Biex tgħaqqad, diversi Stati Membri għal darb'oħra qabżu t-tul massimu ta' 10 paġni li kellu jkollu r-rapport u hemżu bosta annessi u tabelli ta' spjegazzjoni. B'konsegwenza ta' l-inkonsistenzi msemmija hawn fuq, l-evalwazzjoni komuni tar-rapporti ta' l-Istati Membri kienet problematika u l-Kummissjoni kellha tħabbat wiċċha ma’ diffikultajiet serji biex tħares id-data ta' skadenza li kellha (il-31 ta' Lulju 2006) biex tressaq ir-rapport sommarju lis-STECF u lill-Kumitat tas-Sajd u l-Akwakultura. a) Deskrizzjoni tal-flotot fil-konfront tal-qagħda tas-sajd Ir-rapporti annwali ta’ l-Istati Membri taw deskrizzjoni ġenerali tal-flotot tas-sajd skond in-numru ta’ bastimenti, il-kapaċità, l-ispeċijiet fil-mira u ż-żoni tas-sajd. Madankollu, l-Istati Membri użaw sistemi ta’ tqassim differenti: xi wħud żammu s-sistema l-qadima ta' tqassim MAGP IV, filwaqt li oħrajn applikaw is-sistemi ta' tqassim nazzjonali tagħhom. Ġeneralment it-tqassim nazzjonali tal-flotta tas-sajd jitmexxa b'dan il-mod: - it-tqassim MAGP IV jintuża mill-Ġermanja, Franza, il-Portugall, il-Finlandja u l-Irlanda (b'xi żidiet); - skond it-tip/irkaptu tas-sajd/tul totali fid-Danimarka u Ċipru; - skond it-tul totali/irkaptu tas-sajd fil-Greċja u s-Slovenja; - skond l-irkaptu fil-Belġju; - skond iż-żoni tas-sajd ġeografiċi u t-tip ta' bastimenti tas-sajd fi Spanja, fil-Latvja, il-Litwanja u l-Polonja; - skond it-tul totali, żoni tas-sajd, l-irkaptu li ntuża u l-ispeċijiet ta' ħut maqbuda fl-Estonja u l-Iżvezja (bl-eċċezzjoni ta' l-użu ta' żoni tas-sajd bħala indikatur); - jinqasam fi tnejn: it-taqsima ta' l-akkwakultura u l-flotta ta' l-art kontinentali (fil-biċċa l-kbira cutters ) fl-Olanda Numru ta' Stati Membri enfasizzaw li l-flotta kostali tas-sajd fuq skala żgħira (li tirrappreżenta aktar minn 80% tal-flotta totali tas-sajd fil-Komunità) għandha impatt soċjo-ekonomiku importanti ħafna fuq il-komunitajiet kostali. Il-ġestjoni u l-iżvilupp aħjar ta' dan is-settur huma ffisati bħala xogħol ta' prijorità, pereżempju, fl-Iżvezja u l-Greċja. Il-maġġoranza ta' l-Istati Membri fir-rapporti tagħhom ppruvaw jistmaw il-bilanċ bejn il-kapaċità tas-sajd tal-flotta tagħhom u l-opportunitajiet ta’ sajd disponibbli. Intużaw diversi approċċi sabiex jiġu identifikati l-korrelazzjonijiet bejn l-istokkijiet ta' ħut disponibbli u l-flotot tas-sajd ta' l-Istati Membri. Diversi Stati Membri għamlu analiżi ta' l-istokkijiet ta' ħut disponibbli b'rabta mat-tibdil fil-kapaċità f'kull waħda mit-taqsimiet tal-flotot tagħhom. Xi wħud mill-Istati Membri użaw approċċ aktar soċjo-ekonomiku sabiex jevalwaw l-iżviluppi fil-kapaċità tal-flotot tas-sajd. Fl-2005 diversi miżuri ttieħdu mill-Istati Membri sabiex jintlaħaq bilanċ aħjar bejn ir-riżorsi disponibbli u l-flotot tas-sajd: tnaqqis fil-kapaċità tal-flotta, limiti fuq il-ġranet tas-sajd, restrizzjonijiet fuq l-aċċess għar-riżorsi fuq livell nazzjonali, limitazzjonijiet fuq il-liċenzji tas-sajd, l-allokazzjoni ta' kwoti tas-sajd, eċċ. L-Istati Membri kollha rrappurtaw tnaqqis gradwali tal-kapaċità tal-flotot, kemm f'TG kif ukoll f'kW fl-2005, u dan inkiseb primarjament permezz ta' skemi ta' żarmar. b) L-impatt ta’ l-iskemi tat-tnaqqis fl-isforz fuq il-kapaċità Kif issemma hawn fuq, kienu applikabbli miżuri ta' rkupru u skemi għat-tnaqqis ta' l-isforz differenti għall-Istati Membri fl-2005. L-Istati Membri kollha li jistadu f'Kattegat, fil-Baħar tat-Tramuntana u Skagerrak, fil-Punent ta' l-Iskozja, fil-Lvant tal-Kanal, fil-Baħar Irlandiż, fil-Bajja ta' Biscay, fil-Baħar Kantabriju u l-Punent ta' l-Iberja u l-Baħar Baltiku, ġew affettwati mill-miżuri għat-tnaqqis ta' l-isforz tas-sajd (xi wħud minnhom huma stipulati fir-Regolament tal-Kunsill (KE) Nru 27/2005[5]). Ġeneralment, l-implimentazzjoni ta’ dawn il-miżuri involviet it-tnaqqis fin-numru ta’ ġranet li l-bastimenti qattgħu fuq il-baħar u l-irkaptu tas-sajd li użaw. Il-maġġoranza ta’ l-Istati Membri kkonċernati rrappurtaw tnaqqis kumplessiv sod fl-isforzi tagħhom tas-sajd. Barra minn hekk, l-Istati Membri kkonċernati rrappurtaw li t-tnaqqis fl-isforzi tas-sajd tagħhom inkiseb prinċipalment permezz ta' l-applikazzjoni ta' diversi skemi għal-limitazzjoni ta' l-isforzi tas-sajd u kif ukoll skemi ta' żarmar, kemm fuq livell il-Komunitarju kif ukoll fuq dak nazzjonali. Xi wħud mill-Istati Membri stqarru li ż-żieda fil-prezzijiet tal-fjuwil matul l-2005 ukoll kellha rwol importanti fit-tnaqqis ta' l-isforzi tas-sajd tagħhom. Dawn li ġejjin huma xi wħud mill-kummenti mill-Istati Membri dwar l-iskemi dwar l-isforzi tas-sajd fl-2005: Il-Belġju: fl-2005, l-attivitajiet tal-flotta koprew il-Baħar tat-Tramuntana, l-Ilmijiet tal-Punent u l-Bajja ta' Biscay, u ġew imposti restrizzjonijiet skond ir-Regolament 27/2005. F'kull waħda minn dawn iż-żoni, l-flotta ffaċċjat pjan ta' rkupru jew ta' ġestjoni (bl-eċċezzjoni tal-flotta għall-gambli). Barra minn hekk, is-sistema Belġjana tipprovdi restrizzjonijiet għan-numru totali ta' jiem ta' vvjaġġar permessi għal kull bastiment fuq bażi annwali, li tkopri ż-żoni kollha. Ċerti bastimenti fil-flotta tas-sajd tat-tkarkir bit-travu ħassew li l-jiem fuq il-baħar disponibbli fiż-żona ta' rkupru tal-merluzz kienu restrizzjoni ġenwina. In-numru totali ta' jiem fuq il-baħar għall-flotta kollha kemm hi ma nqabiżx, għaliex ċerti bastimenti ma użawx il-jiem kollha li kienu ġew allokati. Ir-restrizzjoni fuq il-jiem ta' vvjaġġar ma kellhiex ir-riżultat li l-kwota disponibbli ma tinqabadx. Id-Danimarka: L-impatt tal-pjan ta' rkupru tal-merluzz għall-Baħar tat-Tramuntana – 71,642 jum fuq il-baħar intużaw meta mqabbla ma 81,330 jum fuq il-baħar fl-2004, tnaqqis ta' 12%. L-interazzjoni bejn ir-riżorsi u l-ġestjoni tal-flotta f'termini ta restrizzjonijiet ta' TAC/kwoti u sforzi/kapaċità ġiet studjata fi proġett ta' riċerka. Il-konklużjoni hi li mil-lat ekonomiku, li fih ir-rendiment ekonomiku tal-flotta fl-isfruttament ta' l-istokkijiet tal-ħut għandu valur għoli, id-daqs tal-flotta jkollu jonqos. F'analiżi ta' 4 xenarji fil-medda ta' qasir żmien, in-numru ta' bastimenti jonqos sostanzjalment fil-każijiet kollha ħlief fejn l-attività tal-bastimenti (jiem fuq il-baħar) tkun limitata. Fil-medda t-twila, it-titjib mistenni jista' jkun sostanzjali f'termini ta' stokkijiet irkuprati. Madankollu, jista' jinkiseb titjib simili permezz ta' ġestjoni tajba tal-flotta li tista' titqabbel mal-ġestjoni ta' l-istokkijiet tal-ħut. Għadu għaddej ix-xogħol sabiex jiġi stabbilit il-bilanċ reali bejn id-daqs tal-flotta u l-possibilitajiet ta' sajd. Il-Ġermanja: Minħabba d-daqs żgħir tal-flotta tas-sajd, l-iskemi tat-tnaqqis ta' l-isforzi tas-sajd kellhom biss impatt limitat fuq il-kapaċità tas-sajd, kważi esklussivament fir-rigward tas-sajd fil-Baħar Baltiku. Fi ħdan il-kuntest tas-sistema tal-ġestjoni tal-flotta sabiex jiġi stabbilit bilanċ sostenibbli bejn il-kapaċità tas-sajd u r-riżorsi disponibbli, il-flotta tas-sajd Ġermaniża għandha żżomm biżżejjed kapaċità kumplessiva sabiex tkun tista' tuża l-kwoti kollha allokati lill-Ġermanja. L-iżvilupp tal-flotta tas-sajd Ġermaniża juri li rnexxielha tadatta kemm għall-kundizzjonijiet ekonomiċi stabbiliti mill-PKS il-ġdida kif ukoll għad-disponibbiltà ristretta ta' riżorsi. Huwa għalhekk li l-awtoritajiet Ġemaniżi ma kellhom għalfejn jieħdu l-ebda azzjoni fl-iżvilupp tal-flotta. L-Estonja: Issegwi tnaqqis tat-TAC għall-merluzz fil-Baħar Baltiku u l-pjan ta' Riġenerazzjoni fi ħdan l-Organizzazzjoni għas-Sajd fil-Majjistral ta' l-Atlantiku skond ir-Regolament tal-Kunsill (KE) Nru 27/2005. Il-Greċja: l-ebda pjanijiet ta' ġestjoni multiannwali u ta' rkupru ta' l-istokkijiet ma ġew applikati minħabba n-nuqqas ta' dawn il-pjanijiet għas-sajd fil-Mediterran, filwaqt li l-applikazzjoni ta' miżuri għall-aġġustament mill-ġdid tal-kapaċità tal-flotta u l-possibilitajiet ta' sajd skond ir-Regolament tal-Kunsill (KE) Nru 2792/1999 u 2369/2002, kompliet fil-qafas tal-Programm Operazzjonali għas-Sajd. Spanja: żammet l-approċċ għat-tiġdid u l-modernizzazzjoni tal-flotta li nbeda fl-2003, skond id-dispożizzjonijiet tar-Regolament 2371/2002. B'dan il-mod, il-ġestjoni ta' żidiet u tnaqqisiet ippermettiet li jinżamm tnaqqis żgħir fil-kapaċità tal-flotta, u b'konsegwenza, fl-isforz ta' sajd kumplessiv. Matul l-2005, ġew implimentati żewġ pjanijiet fuq skala nazzjonali fiż-żona tas-sajd tal-Golf ta' Cadiz. Dawn jikkonċernaw l-irkupru u l-ġestjoni sostenibbli tas-sajd bix-xbieki tat-tkarkir u bil- purse seines rispettivament, u essenzjalment fihom miżuri sabiex jitnaqqsu l-isforzi. Permezz ta' limitazzjoni fuq in-numru ta' jiem, kien possibbli li l-isforzi tas-sajd jitnaqqsu b'madwar 32% ta' isforzi fis-snin mgħoddija. Franza: Il-kapaċità tal-flotta kontinentali Franċiża baqgħet stabbli matul l-2005; l-ebda għajnuna pubblika ma ngħatat għaż-żarmar matul l-2005. Fl-2006 hija prevista skema ġdida ta' żarmar, u din hija mmirata lejn il-flotta li tistad għal stokkijiet li huma sfruttati żżejjed. Il-limitazzjonijiet ta' l-isforzi tas-sajd li ġew adottati fil-qafas tal-pjanijiet ta' rkupru jew skond id-dispożizzjonijiet ta' l-Anness IV tar-regolament dwar it-TAC u l-kwoti jikkonċernaw madwar 850 bastiment; ma seħħ l-ebda tnaqqis fil-kapaċità matul l-2005 b'riżultat ta' dawn il-miżuri. L-Irlanda: is-sajd fl-Irlanda li jaqa' fl-ambitu tal-pjanijiet għall-irkupru ta' l-istokkijiet huwa ta' natura mħallta ferm. B'riżultat ta' dan huwa diffiċli li wieħed ikejjel l-impatt ta' l-iskemi għat-tnaqqis ta' l-isforzi tas-sajd fuq il-kapaċità tas-sajd. Sabiex tkun konformi mar-Regolament tal-Kunsill (KE) Nru 27/2005, l-Irlanda introduċiet sistema li biha l-bastimenti tas-sajd li jistadu fiż-żoni speċifiċi u li jużaw irkaptu tas-sajd speċifiku jkunu obbligati jimlew il-formola ta' "Dikjarazzjoni Uffiċjali dwar il-Jiem fuq il-Baħar". Barra minn miżuri marbuta ma' l-isforzi, assoċjati mal-pjan multiannwali għall-irkupru tal-merluzz fil-Baħar Irlandiż u fil-Punent ta' l-Iskozja, jeżisti wkoll mekkaniżmu ġenerali ta' kontroll ta' l-isforzi li huwa ġeneralment applikabbli għall-ispeċijiet demersali (kif ukoll għall-granċijiet u l-arzell) fl-ilmijiet kollha madwar l-Irlanda. L-Irlanda ssorveljat il-livelli ta' l-isforzi f'dan is-sajd u introduċiet miżuri ta' ġestjoni sabiex iżżomm il-flotta fi ħdan il-limiti ta' l-isforzi allokati. Fl-2005 il-Ministru Irlandiż għall-Baħar nieda skema ġdida għat-tneħħija ta' madwar 25% ta' l-akbar bastimenti u dawk l-aktar attivi fis-setturi demersali (polivalenti tat-tkarkir bit-travu) tal-flotta u wkoll sabiex titneħħa l-kapaċità żejda fil-flotta tas-sajd għall-arzell. 22 bastiment (total ta' 2 464 TG u 7 742 kW) inħarġu mill-flotta taħt din l-iskema fl-2005. L-Italja: ix-xejriet negattivi fil-ħatt l-art irreġistrat matul l-2005 jista' jiġi spjegat f'termini ta' tnaqqis kemm fin-numru ta' bastimenti kif ukoll fil-livell ta' l-attività. F'dan ir-rigward wieħed għandu jiftakar li l-prezzijiet tal-fjuwil kellhom impatt kbir fuq in-numru totali ta' jiem ta' sajd, u ħafna operaturi kellhom jibdlu l-istrateġija ta' sajd tagħhom, jiġifieri kellhom jillimitaw l-isforz tas-sajd sabiex inaqqsu l-ispejjeż operattivi. Fl-2005, il-pjan sabiex titnaqqas il-kapaċità tas-sajd bl-għajnuna tal-finanzi pubbliċi, kif sar fis-snin ta' qabel, ta riżultati tajba. Minkejja li dan m'affettwax il-valutazzjoni dwar il-konformità ma' l-iskema taż-żiediet/tnaqqis, f'termini assoluti kien hemm tnaqqis sinifikanti fl-isforzi tas-sajd fl-ilmijiet Taljani. Ċipru: żewġ bastimenti tat-tkarkir tal-qiegħ ġew skreppjati u żewġ bastimenti ngħataw lill-mużewijiet lokali. Tneħħew total ta' 2 864 TG u 5 423 kW għal kollox mill-flotta. Il-Latvja: matul l-2005, ġew skreppjati 31 bastiment bl-għajnuna pubblika; dawn il-bastimenti kollha ġew irtirati mill-flotta tal-Baħar Baltiku. Ir-raġunijiet ewlenin li għalihom is-sidien ta' dawn il-bastimenti applikaw għaż-żarmar kienu marbuta mal-qagħda mwiegħra ta' l-istokkijiet tal-ħut fil-Baħar Baltiku. L-istokkijiet tal-merluzz, partikolarment, qegħdin f'sitwazzjoni gravi ferm, u għalhekk il-maġġoranza tal-bastimenti li żarmaw kienu bastimenti tas-sajd għal-merluzz. Raġuni importanti oħra għall-iskreppjar kienet li dawn il-bastimenti kienu antiki, ir-rendiment tekniku tagħhom batut, u barra minn hekk, il-prezz tal-fjuwil, flimkien ma' l-ispejjeż l-oħra għall-operazzjonijiet ta' sajd żdiedu mhux bi ftit. L-impatt totali ta' l-iskema għat-tnaqqis ta' l-isforzi tas-sajd kif ukoll tat-tnaqqis tal-flotta tas-sajd Latvjana permezz ta' l-esportazzjoni jew l-iskreppjar tal-bastimenti mingħajr għajnuna pubblika, wassal għal tnaqqis ta' 11% tal-bastimenti tas-sajd għall-merluzz. Mill-1 ta' Mejju 2004, dan it-tnaqqis fil-kapaċità qed jaffettwa pożittivament lill-istokkijiet tal-merluzz kif ukoll ir-riproduzzjoni ta' dan l-istokk ta' l-iprem importanza fil-Baħar Baltiku. Il-Litwanja: Fl-2005, il-kapaċità tal-bastimenti tas-sajd li joperaw fil-Baħar Baltiku u madwar il-kosta tiegħu, meta mqabbla mas-sena 2004, tnaqqset b' 1 576 TG u 3 104 kW. Dan inkiseb permezz ta' l-iskreppjar tal-bastimenti bl-għajnuna pubblika. Tnaqqis ta' 22% tal-kapaċitajiet tas-sajd ta' bastimenti li jistadu fil-Baħar Baltiku wassal għal żieda fil-kwoti tas-sajd għall-bqija tal-bastimenti tas-sajd. Malta: B'mod ġenerali, ix-xejriet staġjonali tas-sajd, kif ukoll is-sajd innifsu baqgħu l-istess fl-2005 bħal fi snin preċedenti u ma waslet l-ebda indikazzjoni ta' żieda fl-isforz ta' sajd fi kwalunkwe tip ta' sajd. Ma ġew implimentati l-ebda skemi għat-tnaqqis ta' l-isforzi tas-sajd u ma jista' jiġi rrappurtat l-ebda impatt fuq il-kapaċità tas-sajd. Il-ġestjoni tas-sajd f'Malta ssir f'konformità mar-Regolament tal-Kunsill 813/2004, li stabbilixxa miżuri għall-kontroll ta' l-isforzi fl-ilmijiet madwar Malta. L-istatus tar-riżorsi sfruttati mill-flotta tas-sajd Maltija huwa tali li mhux meħtieġ tnaqqis fil-kapaċità tas-sajd. L-Olanda: Is-sitwazzjoni inkwetanti fis-settur Olandiż tal- cutters, bi kwoti mnaqqsa u spejjeż ogħla ferm, issa ilha snin magħna. Opportunitajiet għall-qbid tal-barbun tat-tbajja'; naqsu partikolarment f'dawn l-aħħar ftit snin. Għaldaqstant, l-awtoritajiet u l-industrija tas-sajd żviluppaw numru ta' inizjattivi sabiex titnaqqas il-pressjoni fuq l-istokkijiet tal-barbun tat-tbajja'. Waħda minn dawn tinvolvi ż-żarmar ta' parti mill-flotta biex b'hekk il-kapaċità għall-qbid titnaqqas għal dejjem. Dan niżżel il-kapaċità għal livell aktar bilanċjat ma' l-opportunitajiet ta' qbid u dan huwa ta' għajnuna għall-irkupru ta' l-istokkijiet tal-barbun tat-tbajja'. Konsegwenza oħra hija prospettivi finanzjarji aħjar għall-bqija tas-sajjieda fid-dawl tal-fatt li issa l-opportunitajiet tal-qbid huma aktar għal kull bastiment. F'Settembru 2005, ir-regolament dwar it-tnaqqis tal-kapaċità tas-sajd fil-baħar daħal fis-seħħ – u b'riżultat ta' dan żarmaw 29 bastiment, b'kollox 36 092 kW u 8 982 TG. Parzjalment b'riżultat ta' dan ir-regolament kien hemm tnaqqis fil-flotta tal- cutters li għen sabiex jintlaħaq bilanċ aktar sostenibbli bejn il-flotta u l-opportunitajiet eżistenti tas-sajd. Fl-2005 il-jiem-kW tal-flotta Olandiża tal- cutters fiż-żona tal-pjan ta' rkupru għall-Baħar tat-Tramuntana tnaqqsu bi 15% minn kif kienu fl-2005. Sa fejn hi involuta l-bqija tal-flotta, id-daqs tagħha jista' jiġi ġustifikat f'termini tad-daqs attwali u l-qagħda ta' l-istokkijiet tal-ħut. It-tnaqqis li sar fil-kapaċità u t-tnaqqis fil-kapaċità użata fl-2005 ħolqu bilanċ aktar sostenibbli bejn id-daqs ta' l-istokkijiet u dak tal-flotta. Il-Polonja: nediet skema għat-tnaqqis ta' l-isforzi tas-sajd l-aktar minħabba l-kapaċità żejda għall-isforzi tas-sajd għall-merluzz fil-Baħar Baltiku kif ukoll minħabba profitti baxxi. Matul l-2005, ġew skreppjati jew qalbu għal attivitajiet oħra 270 bastiment, u l-irtirar permanenti tal-kapaċità tas-sajd ammontat għal 15 564 TG u 42 237 kW . Il-Portugall: il-flotta ġiet affettwata minn dawn il-limitazzjonijiet ta' l-isforzi: għas-sajd bit-tartaruni għas-sardin, il-pjan ta' rkupru għall-Marlozz tan-Nofsinhar (Regolament tal-Kunsill (KE) Nru 27/2005), il-Pjan ta' Rkupru għall-Ħalibatt ta' Greenland fin-NAFO u r-Regolamenti dwar l-ispeċijiet tal-baħar fond. Għal dan ta' l-aħħar, il-Portugall uża sistema ta' liċenzji sabiex jiġi limitat l-aċċess ta' bastimenti għas-sajd fil-baħar fond. Ġew approvati 34 proposta għat-tnaqqis fl-2005 u 25 bastiment diġà ġew skreppjati matul is-sena fit-taqsima tal-flotta ta' l-art kontinentali. Dan jirrappreżenta tnaqqis ta' 5 011 GT u 10 123 kW. Is-Slovenja: ma tista' tirrapporta dwar l-ebda impatt fuq il-kapaċità għas-sajd li jirriżulta minn skemi għat-tnaqqis ta' l-isforzi peress li għadhom ma ġewx introdotti pjanijeit ta' ġestjoni jew ta' rkupru għas-sajd fil-Mediterran. Fl-istess waqt m'hemm l-ebda skemi għaż-żarmar jew l-irtirar għall-bastimenti tas-sajd. Il-Finlandja: ġiet elaborata skema speċjali għat-tnaqqis tal-kapaċità tas-sajd. Dan kien riżultat ta' l-għarfien dwar il-kapaċità żejda fis-sajd għall-aringi u għal-laċċa kaħla kif ukoll għall-projbizzjoni fuq l-għeżula tal-mitlaq fil-Baħar Baltiku. Il-Finlandja daħlet għal din l-iskema tat-tnaqqis tal-kapaċità fir-rigward tat- trawlers pelaġiċi u t-taqsima tal-bastimenti li jistadu bl-irkaptu passiv. Ġew irtirati 1,378 GT u 6,025 kW bl-għajnuna pubblika. L-isforz tal-flotta pelaġika naqas konsiderevolment – b'madwar 15% ta' l-isforzi annwali tas-snin 2003-2005. Is-sajd bl-irkaptu rmunkat u l-irkaptu statiku għall-ispeċijiet demersali (prinċipalment merluzz) naqas ferm fl-2005 – madwar 79% - madankollu dan jikkonċerna biss qabda żgħira u ftit bastimenti. L-isforz fis-sajd għas-salamun, it-trota u l-ispeċijiet ta' l-ilma ħelu naqas ħafna f'dan l-aħħar snin: madwar 88 % L-Iżvezja: fl-ambitu tal-pjanijiet multi-annwali ta' ġestjoni u ta' rkupru li ġew introdotti fil-Baħar tat-Tramuntana, il-kapaċità tas-sajd fil-Iskagerrak u l-Kattegat tnaqqset bil-mod il-mod b'riżultat ta' TACs aktar baxxi u anqas jiem fuq il-baħar. Regoli nazzjonali li jinvolvu aġġustamenti għal-limitu tax-xbieki tat-tkarkir, l-introduzzjoni ta' xbieki tat-tkarkir li jagħżlu l-ħut skond id-daqs u r-restrizzjoni tas-sajd bix-xbieki tat-tkarkir u bl-għeżula mal-kosta, komplew naqqsu l-kapaċità. Il-liċenzji speċjali tas-sajd għall-merluzz tal-Baltiku rrestrinġew il-kapaċità għal dak it-tip ta' sajd. Fid-dawl tas-sitwazzjoni serja fir-rigward ta' l-istokkijiet ta' speċijiet ta' ħut tal-qiegħ fil-Kattegat u Skagerrak u billi tqies is-sajd kostali bl-irkaptu statiku, l-opportunitajiet ta' sajd ġew ristretti fi ħdan 'il-limitu tax-xbieki tat-tkarkir' fiż-żoni kostali. Ir-restrizzjonijiet fissru li s-sajd bil- purse seines ġie pprojbit f'żewġ sistemi ta' fjords oħra. Ġew imposti restrizzjonijiet ta' żmien fuq is-sajd bil- purse seines u bid-dwal. L-opportunitajiet tas-sajd pelaġiku għall-aringi wkoll ġew ristretti u l-akbar fost il-bastimenti pelaġiċi m'għadhomx jitħallew ikollhom liċenzja għas-sajd kostali. Is-sajd pelaġiku bix-xbieki tat-tkarkir ġie pprojbit f'żoni ta' importanza partikolari għas-sajjieda li jużaw in-nases. Fi ftit kliem, il-maġġoranza ta' l-Istati Membri kkonfermaw li l-iskemi eżistenti għat-tnaqqis fl-isforzi tas-sajd ġeneralment taw riżultati tajba u għenu sabiex jinkiseb bilanċ aħjar bejn il-kapaċità u l-opportunitajiet tas-sajd. Barra minn hekk xi Stati Membri indikaw li li l-miżuri biex jitnaqqsu l-kapaċità u l-isforzi tas-sajd għandhom jittejbu fil-ġejjieni. Pereżempju, il-Belġju nnota li s-sajjieda tiegħu ilhom jafu li l-istokkijiet tal-ħut m'għadhomx l-istess bħalma kienu għaxar snin ilu. Jaċċettaw li għalhekk tinħtieġ azzjoni sabiex l-istokkijiet tal-ħut isiru anqas vulnerabbli u li l-flotta jkollha tiċkien sabiex is-sajjieda li jkun għad fadal ikunu jistgħu jibqgħu jistadu b'mod sostenibbli u ekonomikament vijabbli. Madankollu, ir-restrizzjonijiet li jirriżultaw mill-pjanijiet ta' rkupru jew ta' ġestjoni iridu jagħtu l-frott b'mod li jidher sew fil-medda qasira għal dik medja, jekk għandhom jibqgħu kredibbli u aċċettabbli għas-sajjieda. Studju fil-Belġju indika li għandu jseħħ tnaqqis ta' 10 000 kW mill-flotta Belġjana (15% tal-kapaċità attwali tal-flotta) sabiex din tkun tista' tifdi saħansitra fil-medda l-qasira abbażi ta' l-istruttura ta' l-ispejjeż u l-opportunitajiet ta' qbid attwali. Bl-istess mod, l-Iżvezja ssuġġeriet li huwa mixtieq tnaqqis ulterjuri fil-kapaċità bil-għan li jintlaħaq bilanċ bejn il-kapaċità u l-opportunitajiet. Dan huwa wkoll prerekwiżit biex tinħoloq vijabbiltà fit-tul fil-flotta tas-sajd. L-istokkijiet tal-ħut x'aktarx se jibqgħu fl-istess livell għall-ftit snin li ġejjin u għalhekk wieħed jista' jistenna li d-daqs tal-flotta jkompli jiċċekken. Huwa importanti wkoll li l-ġestjoni tal-flotot tiġi kkombinata ma' miżuri oħra sabiex jinħoloq bilanċ bejn il-kapaċità tas-sajd u r-riżorsi bħal, pereżempju, miżuri mmirati lejn it-tqassim tal-kwoti u l-opportunitajiet tas-sajd kif ukoll restrizzjonijiet fuq l-isforzi u l-irkaptu. ċ) Punti pożittivi u punti negattivi Ir-reġim taż-żieda/ħruġ ġie segwit mill-Istati Membri kollha. Fil-maġġoranza tal-każijiet id- data tar-reġistri tal-flotot nazzjonali ġiet rappurtata b'suċċess lill-Kummissjoni skond ir-Regolament 26/2004. Madankollu għad baqa' ftit diffikultajiet ta' organizzazzjoni u ta' l-ipproċessar tad- data; dan jirriżulta l-aktar mill-kapaċità amministrattiva limitata f'xi wħud mill-Istati Membri. Minkejja dawn id-diffikultajiet, il-kwalità tad- data li ntbagħtet lill-Kummissjoni mill-Istati Membri tjiebet b'mod sinifikanti matul l-2005. Wieħed mill-aktar kompiti importanti kien il-proċess attwali tal-verifikar tad- data fir-Reġistru tal-Flotot u l-verifikar tat-"twissijiet". Fl-2005, kważi l-Istati Membri kollha kellhom sistemi integrati funzjonali ta' l-informazzjoni dwar is-sajd, li kemm-il darba kienu jinkludu diversi applikazzjonijiet ta' softwer (reġistru tal-flotta, ġestjoni tal-kapaċità, liċenzji, ħatt l-art, kwoti disponibbli, rappurtar tal-qabdiet, eċċ.). Fl-2005, tnedew fl-Irlanda u l-Iżvezja verżjonijiet ġodda ta' sistemi ta' l-IT marbuta mas-sajd. Is-Slovenja wkoll ħadmet fuq l-introduzzjoni ta' sistema integrata ta' informazzjoni dwar is-sajd. Dawn is-sistemi, fil-biċċa l-kbira tal-każi jorbtu diversi korpi amministrattivi kif ukoll korpi amministrattivi ċentrali ma' dawk lokali, u b'hekk isaħħu konsiderevolment l-amminsitrazzjoni tal-flotot tas-sajd nazzjonali. Barra minn hekk, l-Istati Membri stqarrew li r-reġistri nazzjonali huma preċiżi, kompleti u aġġornati. d) Konformità mas-sistema taż-żieda-tneħħija u mal-livelli ta’ referenza Fir-rapporti tagħhom, l-Istati Membri kollha stqarrew li jaderixxu bis-sħiħ mar-regoli eżistenti dwar iż-żieda – tneħħija. Il-konformità mas-sistema taż-żieda-tneħħija u mal-livelli ta’ referenza (jekk japplikaw) fl-aħħar ta’ l-2005 hi stipulata fl-Annessi Tekniċi 1, 2 billi jkunu applikati l-formuli ffissati fir-Regolament tal-Kummissjoni (KE) Nru 1438/2003. Dawn l-annessi tekniċi li huma bbażata fuq id- data CFR jagħtu informazzjoni globali dwar il-konformità għall-Komunità u wkoll skond l-Istat Membru. 4. KONKLUŻJONIJIET MILL-KUMMISSJONI Il-kwalità tar-rapporti mressqa mill-Istati Membri tjiebet ħdejn dik ta' l-2004. Xi Stati Membri taw rapporti dettaljati ħafna, li l-kontenut tagħhom kien aktar mill-informazzjoni li kienu obbligati li jipprovdu. Minkejja dan, Stati Membri oħra ma rrispettawx id-data ta' skadenza għall-preżentazzjoni inkella ma rrispettawx ir-rekwiżiti f'termini ta' format jew kontenut li huma stabbiliti fl-Artikolu 13 tar-Regolament tal-Kummissjoni (KE) Nru 1438/2003; waqt li kien qed jitħejja dan ir-rapport, ir-Renju Unit kien għadu ma ppreżentax ir-rapport annwali tiegħu. L-Istati Membri saħqu fir-rapporti tagħhom dwar l-implimentazzjoni tas-sistema ta' ġestjoni tal-flotta nazzjonali, iżda l-valutazzjonijiet tal-bilanċ bejn il-kapaċità tal-flotta tas-sajd u l-opportunitajiet ta' sajd disponibbli huma aktar kompleti minn dawk ippreżentati f'rapporti fl-imgħoddi. Riżultati għall-flotta kontinentali (flotta tal-Komunità minbarra bastimenti reġistrati fir-reġjuni ta’ barranett): Skond ir-Reġistru tal-Flotta tal-Komunità matul l-2003 u l-2004, il-kapaċità globali tal-flotta tal-Komunità tal-15-il Stat Membru ta' l-UE tnaqqset b'117,000 TG u 499.000 kW, li tirrappreżenta tnaqqis nett ta' 6,27 % tat-tunnellaġġ totali u 7,28 % tas-qawwa tal-flotta ta' l-UE-15. It-tnaqqis nett matul l-2005 kien ta’ madwar 50,000 TG filwaqt li kien madwar 23,000 TG fl-2004 u 44,000 TG fl-2003. Dan it-tnaqqis jidher li hu relattivament baxx, jekk wieħed iqis il-livelli għolha ta' pressjoni tas-sajd fil-maġġoranza tas-setturi tas-sajd fil-Komunità, partikolarment l-ispeċijiet demersali. Fl-Istati Membri l-ġodda, mill-bidu ta’ l-1 ta’ Mejju 2004, il-kapaċità tal-flotta tnaqqset b'41.000 TG u 101,000 kW, li tirrappreżenta tnaqqis ta' 18 % tat-tunnellaġġ u 18 % tal-qawwa tal-flotot tagħhom imqabbla mal-kapaċità tas-sajd fid-data ta' l-adeżjoni. Matul l-2003, l-2004 u l-2005 ġew irtirati madwar 132,000 TG u 427,000 kW mill-flotta ta' l-UE bl-għajnuna pubblika, li jfisser li din il-kapaċità ma tistax tiġi ssostitwita. Minn din il-kapaċità li ġiet irtirata bl-għajnuna pubblika, il-maġġoranza kbira (112,000 TG u 373,000 kW) ġew mill-Istati Membri ta' l-UE-15. Il-kapaċità li ġiet irtirata mill-Istati Membri l-ġodda bl-għajnuna pubblika mill-1 ta' Mejju 2004 kienet ta' 20,000 TG u 54,000 kW. It-Tabelli 1 u 2 fl-Anness Tekniku jagħtu fil-qosor il-konformità, fil-31 ta’ Diċembru 2005, mas-sistema ta’ żieda-tneħħija u l-livelli ta’ referenza. Il-maġġoranza ta' l-Istati Membri qablu ma' dawn ir-regoli. Madankollu, l-Greċja ma kkonformatx mas-sistema taż-żieda-tneħħija f'termini ta' tunnellaġġ, minkejja li l-livell ta' non-konformità huwa żgħir ħafna, peress li l-limitu ta' tunnellaġġ inqabeż biss b'0.29%. L-awtoritajiet Griegi jikkontestaw il-valutazzjoni tal-Kummissjoni; fil-fehma tagħhom, il-Greċja kkonformat mas-sistema taż-żieda-tneħħija. It-Tabelli 3 u 4 fl-Anness Tekniku 1 jagħtu fil-qosor il-varjazzjoni fil-kapaċità tal-flotta mill-1 ta’ Jannar 2003 (1 ta’ Mejju 2004 għall-Istati Membri l-ġodda) sal-31 ta’ Diċembru 2005. Dawn it-tabelli jinkludu wkoll in-numru ta’ bastimenti. It-tabella 3 tkopri l-Istati Membri kollha. Il-valutazzjoni dettaljata għal kull Stat Membru tinsab fl-Anness Tekniku 2. Ir-riżultati għall-flotot reġistrati fir-reġjuni ta’ barranett: Il-kapaċità tal-flotot reġistrati fir-reġjuni ta’ barranett u l-varjazzjoni tagħha bejn l-1 ta’ Jannar 2003 u l-31 ta’ Diċembru 2005 jidhru f’Tabella 4. Ir-riżultati juru li l-flotta rreġistrata fir-reġjuni ta' barranett Spanjoli u Portugiżi tnaqqset ferm kemm f'termini ta' tunnellaġġ kif ukoll f'termini ta' qawwa. Għad-dipartimenti Franċiżi lil hinn mill-Ewropa kien hemm tnaqqis żgħir fin-numru totali ta' bastimenti u t-tunnellaġġ tagħhom u żieda fil-qawwa. It-tabelli fl-Anness Tekniku 3 juru d-dettalji ta’ l-applikazzjoni tas-sistema speċjali għal dawn il-flotot. Mis-17-il reġjun ta' barranett, wieħed kien qabeż il-livell ta’ referenza tiegħu f'termini ta' qawwa fi tmiem l-2005 (it-taqsima '4FJ – bastimenti b'tul inqas minn 12-il m tad-Dipartiment Franċiż ta’ Martinique) u taqsima oħra qabżet il-livell ta' referenza tagħha f'termini ta' tunnellaġġ (it-taqsima 'CA3' – bastimenti ta' aktar minn 12-il m fit-tul reġistrati fil-Gżejjer Kanari u li jistadu f'ilmijiet internazzjonali u ta' pajjiżi terzi). Is-sistema speċjali ma tibqax tapplika għal dawn it-taqsimiet meta jilħqu l-livell ta' referenza massimu tagħhom u r-referenza għar-regolament[6]. Rimarki ġenerali Kif inhu spjegat hawn fuq, dan ir-rapport ta' sinteżi huwa bbażat fuq ir-rapporti annwali ta' l-Istati Membri u fuq id- data mis-CFR. Jibqgħu xi diskrepanzi marġinali bejn iċ-ċifri ppreżentati mill-Istati Membri fir-rapporti tagħhom u dawk li jirriżultaw mid-dikjarazzjonijiet tagħhom lis-CFR. Bis-saħħa ta' l-isforzi ta' l-Istati Membri u tal-Kummissjoni sabiex id- data tagħhom tiġi sinkronizzata, dawn id-diskrepanzi mhumiex importanti mil-lat tal-ġestjoni tal-flotot. Madankollu, għandu jibqa' għaddej ix-xogħol sabiex dawn id-differenzi jispiċċaw għal kollox. Id- data ppreżentata mill-Istati Membri fir-rapporti nazzjonali tagħhom ma tbiddilx il-konklużjonijiet tar-rapport. Skond l-Artikolu 16 tar-Regolament tal-Kunsill (KE) Nru 2371/2002, dawk l-Istati Membri li ma jikkonformawx ma’ Artikoli 11, 13 u 15 ta’ dan ir-Regolament għandhom ikunu obbligati li jnaqqsu l-isforz tas-sajd tagħhom għal livell li kellu jkun hemm kieku ikkonformaw ma' l-artikoli msemmija hawn fuq. Barra minn hekk, huma jistgħu jkunu soġġetti għal sospensjoni proporzjonali fl-għajnuna finanzjarja tal-Komunità taħt il-FIFG. Sabiex tkompli ttejjeb il-kwalità tar-rapporti annwali, il-Kummissjoni, flimkien mal-Kumitat tas-Sajd u l-Akwakultura, bi ħsiebha tistabbilixxi linji-gwida aktar dettaljati dwar il-kontenut tagħhom u ddaħħal approċju metodoloġiku komuni armonizzata b’enfasi akbar fuq l-analiżi ta’ l-iżvilupp fil-kapaċità tas-sajd skond l- istokkijiet tal-ħut disponibbli. Dawn is-suġġetti se jkunu diskussi fil-laqgħat li ġejjin tal-Kumitat tas-Sajd u l-Akwakultura. Fir-rapporti annwali li ġejjin għandha tingħata aktar attenzjoni lill-kontribut tas-sistema l-ġdida adottata fl-2002 għall-ġestjoni tal-flotta tal-Komunità biex jintlaħaq bilanċ aħjar bejn il-flotot u l- istokkijiet tal-ħut. L-impatt ta’ l-iskemi nazzjonali biex jitneħħew il-bastimenti mis-servizz, b'mod partikulari dwar it-tnaqqis fl-isforzi tas-sajd soġġetti għal pjanijiet ta' immaniġjar jew irkuprar, għandhom ikunu identifikati u evalwati aħjar. TECHNICAL ANNEX 1 – SUMMARY TABLES AND GRAPHS Fleet Management in the reformed Common Fisheries Policy a) Entry/Exit regime From 1 January 2003 Member States have had to respect a strict entry-exit regime applying to the capacity of their fleets, measured in terms of both tonnage and power. Any entry of capacity into the fleet of a Member State has to be compensated by the previous exit of at least the same amount of capacity (ratio 1:1, “at any time”), unless the entry corresponds to works to improve safety, hygiene or living and working conditions on board (Article 11(5) of Council Regulation (EC) No 2371/2002). For entries of new vessels between 100 and 400 GT built with public aid (the administrative decisions granting aid were possible only until 31 December 2004) the Member State has to withdraw 35% more capacity than it introduces (ratio 1:1.35). Another important rule is that capacity leaving the fleet with public aid cannot be replaced. Such capacity is subtracted directly from the fleet and also from the reference level established in accordance with Article 12 of Council Regulation (EC) No 2371/2002, and it therefore counts against the entry/exit regime in the ratio 0:1. Capacity reductions supported with public aid are therefore definitive. All of this means that, as a general rule, the capacity of the national fleets cannot increase with respect to its levels on: - 1 January 2003 for EU-15 Member States in accordance with Article 6 and 7 of Commission Regulation (EC) No 1438/2003; - 1 May 2004 for new Member States in accordance with Article 1(2) and 1(3) of Commission Regulation (EC) No 916/2004. In practice this is likely to be the case. However, the implementing rules for the fleet policy allow for the introduction of vessels outside the framework of the entry/exit regime in the case where administrative decisions have been made by the national authorities: - between 1 January 2000 and 31 December 2002 for those vessels to enter the fleet after 1 January 2003 in EU-15 Member States and, - between 1 May 2001 and 30 April 2004 for vessels which enter the fleet after 1 May 2004 in new Member States. These entries have to take place at the most 3 years after the date of the administrative decision (i.e. for EU-15 Member States at the latest by the end of 2005 and for new Member States until 30 April 2007) and must comply with the rules that existed at that time, in particular Article 9 of the Council Regulation (EC) No 2792/1999 regarding Community structural assistance in the fisheries sector. b) Reference Levels (mainland fleet) The reference levels for the fleets of Member States are the sum of the global final objectives of Multiannual Guidance Programme (MAGP IV) as established by Article 12 of Council Regulation (EC) No 2371/2002. The general rule is that Member States may not exceed their reference levels at any time. When a Member State undertakes decommissioning with public aid, these reference levels are automatically reduced by the amount of capacity scrapped. In addition, Member States which gave aid to construction of vessels until the end of 2004 will see their initial 2003 reference level reduced at least by 3% by the end of 2004. Since the reference levels are a legacy of MAGP IV[7] (period 1997 – 2002), the Council decided that they would not apply to the new Member States (Council Regulation (EC) No 1242/2004[8]). c) Management of fleet reference levels in the outermost regions The fishing fleets registered in the Community outermost regions, namely the French Overseas Departments, the Spanish Canary Islands and the Portuguese Azores and Madera have to comply with specific reference levels for these regions in accordance with Council Regulation (EC) No 639/2004[9] and Commission Regulation (EC) No 2104/2004[10]. d) Measurement of tonnage The measurement of the Community fleet is based on Council Regulation (EC) No 3259/94[11] and Commission Decision No 95/84/EC[12]. These legislative acts establish that the tonnage of vessels of 15 m in length or more has to be measured in accordance with the London Convention, i.e. as a function of the vessel’s total enclosed volume, while for vessels of less than 15 m in length, the regulation defines a system of tonnage calculation based on an estimate of the hull’s volume. The fleet should have been entirely measured in accordance with Community law by 31 December 2003. Nevertheless, at the end of 2005, for some Member States there remained number of vessels that were not measured in GT. In cases where the measurement of the fleet has not been completed, the tonnage figures used in this report are a mixture of GT and GRT. That is, for vessels whose GT tonnage is not available the GRT value is used. e) Community Fishing Fleet Register In 2004, the new Community Fleet Register was set up in accordance with Commission Regulation (EC) No 26/2004. It became operational on 1st September 2004. This change was necessary in order to follow up the new rules for managing the fishing capacity of the EU fleet which entered into force on 1st January 2003. This system, following the 2002 CFP reform , gives more responsibility to the Member States in achieving a better balance between the fishing capacity of their fleets and the available resources. The main tool for monitoring the fishing fleet is the Community Fleet Register (CFR). According Commission Regulation (EC) No 26/2004, Member States are obliged on a quarterly basis ("snapshots" shall be sent on the first working day of March, June, September and December) to transmit electronically all relevant information on the characteristics of approximately 88,500 marine fishing vessels, together with information on entries to and exits from the fleet. Furthermore, the CFR is managed via web based application, called the Community Fleet Register On the Net (FRONT). The FRONT is also available for the general public on the following web page: http://ec.europa.eu/comm/fisheries/fleet/index.cfm It is important to note that all information contained in the Technical Annexes 1, 2 and 3 has been taken from the CFR, with the exception of: - data on entries corresponding to administrative decisions taken by national authorities before 1 January 2003 (or 1 May 2004 for the new Member States) and for which the special transitional provisions established in the regulation apply; - data on exits with public aid in some cases where this was not available. Only in these two cases has the information been taken directly from the Member States. The reference levels for the outermost regions were fixed for each segment of the fleet on the 1 January 2003. At any later date, the reference level for each segment is calculated by deducting from the initial reference levels the capacity withdrawn with public aid for that particular segment. It is in this way that the graphs presented below have been calculated.
