Opinion of the Advisory Committee on restrictive practices and dominant positions given at its 380th meeting on 27 September 2004 concerning a preliminary draft decision in Case COMP/C.37.750 — French beer

1. The Advisory Committee agrees with the Commission on the basic amount of the fines based on the gravity and duration of the infringement for both parties.

2. The Advisory Committee agrees with the Commission on the increase of the basic amount of the fine due to the aggravating circumstances for Danone/Brasseries Kronenbourg.

3. The Advisory Committee agrees with the Commission on the final amount of the fine to be imposed on each undertaking.

4. The Advisory Committee recommends the publication of its Opinion in the Official Journal of the European Union.
