During the oral and written procedures, no real problem concerning the right to be heard was raised by the parties.
In view of the written replies to the statement of objections and the results of the hearing, the Directorate-General for Competition has decided to consider the infringement to have ceased on 31 December 1999 as clear evidence of it existed only up to that date, whereas the statement of objections referred to September 2000. Account is taken of this in the calculation of the fine.
The draft final decision does not contain any objections on which the firms did not have to comment.
