Proposal for a COUNCIL REGULATION modifying Regulation (EC) No 745/1999 opening and providing for the administration of autonomous Community tariff quotas for certain fishery products

EXPLANATORY MEMORANDUM

1. Following the request made by a Member State, the Commission services conducted a study of the possibilities for modifying Regulation (EC) No 745/1999 opening and providing for the administration of autonomous Community tariff quotas for cod.

2. This study made it possible to establish that a solution foreseeing an increase of the quota for cod is necessary to ascertain the needs of the community market, without disturbing the markets for such products nor endangering community producers interests.

This is the purpose of the attached proposal.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 26 thereof,

Having regard to the proposal from the Commission [1],

Whereas:

(1) By Regulation (EC) No 745/1999 [2], the Council opened autonomous tariff quotas for certain fishery products.

(2) The quota amount is insufficient to meet the needs of the Community industry for cod under order number 09.2753 and that quota amount should accordingly be increased as from 1 April 1999 so as to ensure uninterrupted use of that quota,

HAS ADOPTED THIS REGULATION:

Article 1

In the Annex to Regulation (EC) No 745/1999, the amount of the tariff quota for order number 09.2753 is set at 75 000 tonnes.

Article 2

This Regulation shall enter into force on the seventh day following that of its publication in the Official Journal of the European Communities.

It shall apply from 1 April 1999.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
