Form of order sought

The applicant claims that the Court should:

Annul Council Decision (CFSP) 2022/582 of 8 April 2022 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (1) (‘Contested Decision’), in so far as it concerns the applicant;

Annul Council Implementing Regulation (EU) 2022/581 of 8 April 2022 implementing Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (2), in so far as it concerns the applicant;

Order the defendant to compensate the material and non-material damage suffered by the applicant;

Order the defendant to bear the full costs and expenses of the proceedings, including those incurred by the applicant for his defence.

Pleas in law and main arguments

In support of the action, the applicant relies on four pleas in law.

1.

First plea in law, alleging that Article 2(1)(g) of Council Decision 2014/145/CFSP of 17 March 2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (3), as amended by Council Decision (CFSP) 2022/329 of 25 February 2022 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (4), and Article 3(1)(g) of Council Regulation (EU) No 269/2014 of 17 March, 2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (5), as amended by Council Regulation (EU) 2022/330 of 25 February 2022 amending Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (6), are illegal and breach the principles of proportionality, legal certainty and equal treatment.

2.

Second plea in law, alleging a breach of the obligation to state reasons.

3.

Third plea in law, alleging a manifest error in the assessment of the facts.

4.

Fourth plea of law, alleging a disproportionate infringement of the right to property.
