REGLAMENTO DEL CONSEJO

por el que se modifican las listas de los procedimientos de insolvencia, los procedimientos de liquidación y los síndicos de los anexos A, B y C del Reglamento (CE) n° 1346/2000 sobre procedimientos de insolvencia

EL CONSEJO DE LA UNIÓN EUROPEA,

Visto el Tratado constitutivo de la Comunidad Europea,

Visto el Reglamento (CE) nº 1346/2000 del Consejo, de 29 de mayo de 2000, sobre procedimientos de insolvencia([1]) y, en particular, su artículo 45,

Vista la propuesta de la Comisión ([2]),

Considerando lo siguiente:

(1) Los anexos del Reglamento (CE) n° 1346/2000 enumeran las designaciones que se dan en la legislación nacional de los Estados miembros a los procedimientos y síndicos a los que se aplica dicho Reglamento. El anexo A del Reglamento (CE) n° 1346/2000 enumera los procedimientos de insolvencia mencionados en la letra (a) del artículo 2 de dicho Reglamento; el anexo B enumera los procedimientos de liquidación mencionados en la letra (c) del artículo 2; y el anexo C enumera los síndicos mencionados en la letra (b) del artículo 2 de dicho Reglamento.

(2) Los anexos A, B y C del Reglamento (CE) n° 1346/2000 fueron modificados por el Acta de Adhesión de 2003 a fin de incluir los procedimientos de insolvencia, los procedimientos de liquidación y los síndicos de los Estados adherentes.

(3) Bélgica, España, Italia, Letonia, Lituania, Malta, Hungría, Austria, Polonia, Portugal y el Reino Unido han notificado a la Comisión, de conformidad con el artículo 45 del Reglamento (CE) n° 1346/2000, las modificaciones efectuadas a las listas que figuran en los anexos A, B y C de dicho Reglamento.

(4) El Reglamento (CE) n° 1346/2000 debe, por tanto, modificarse en consecuencia,

HA ADOPTADO EL PRESENTE REGLAMENTO:

Artículo 1

El Reglamento (CE) n° 1346/2000 se modifica del siguiente modo:

(1) El Anexo A queda sustituido por el texto que figura en el anexo A del presente Reglamento;

(2) El anexo B queda sustituido por el texto que figura en el anexo B del presente Reglamento;

(3) El anexo C queda sustituido por el texto que figura en el anexo C del presente Reglamento.

Artículo 2

El presente Reglamento entrará en vigor el día siguiente al de su publicación en el Diario Oficial de la Unión Europea .

El presente Reglamento será obligatorio en todos sus elementos y directamente aplicable en todos los Estados miembros.
