af 28 . februar 1984

om faellesskabslisten over ugunstigt stillede landbrugsomraader i henhold til direktiv 75/268/EOEF ( Det forenede Kongerige )

RAADET FOR DE EUROPAEISKE FAELLESSKABER HAR -

under henvisning til traktaten om oprettelse af Det europaeiske oekonomiske Faellesskab ,

under henvisning til Raadets direktiv 75/268/EOEF af 28 . april 1975 om landbrug i bjergomraader og i visse ugunstigt stillede omraader ( 1 ) , senest aendret ved direktiv 82/786/EOEF ( 2 ) , saerlig artikel 2 , stk . 2 ,

under henvisning til forslag fra Kommissionen ,

under henvisning til udtalelse fra Europa-Parlamentet ( 3 ) , og

ud fra foelgende betragtninger :

Ved direktiv 75/276/EOEF ( 4 ) angives , hvilke omraader i Det forenede Kongerige der er optaget paa faellesskabslisten over ugunstigt stillede omraader i henhold til artikel 3 , stk . 4 , i direktiv 75/268/EOEF ;

Det forenede Kongeriges regering har i henhold til artikel 2 , stk . 1 , i direktiv 75/268/EOEF anmodet om , at arealet af de ugunstigt stillede omraader udvides gennem en omdefinering af disse omraader ; direktiv 75/276/EOEF boer derfor erstattes med naervaerende direktiv ;

Det forenede Kongeriges regering har i henhold til artikel 2 , stk . 1 , i direktiv 75/268/EOEF givet Kommissionen meddelelse om seks omraader , som vil kunne optages paa listen over ugunstigt stillede landbrugsomraader , og har meddelt oplysninger om disse omraaders saerlige kendetegn ;

foelgende kendetegn for de forholdsvis uproduktive jorder omhandlet i artikel 3 , stk . 4 , litra a ) , i direktiv 75/268/EOEF , er blevet lagt til grund med henblik paa at afgraense hvert enkelt af de paagaeldende omraader : graesarealet udgoer over 70 % af det udnyttede landbrugsareal , dyrebestanden er under 1 enhed stort kvaeg ( ESK ) pr . hektar foderareal og forpagtningsbeloebene overstiger ikke 65 % af det nationale gennemsnit ;

bedrifternes oekonomiske resultater , der ligger vaesentligt under gennemsnittet , som omhandlet i artikel 3 , stk . 4 , litra b ) , i direktiv 75/268/EOEF , er blevet defineret ved hjaelp af et kendetegn , der henviser til arbejdsindkomsten , som ikke overstiger 80 % af det nationale gennemsnit ;

med hensyn til den ringe befolkningstaethed , som omhandlet i artikel 3 , stk . 4 , litra c ) , i direktiv 75/268/EOEF , overstiger det anvendte kendetegn ikke 55 indbyggere pr . km2 ( exkl . befolkning i by - og industricentre ) , idet det nationale gennemsnit og faellesskabsgennemsnittet er henholdsvis 229 og 163 indbyggere pr . km2 ; den i landbruget beskaeftigede befolkning ( exkl . by - og industricentre ) udgoer en ringe andel af den samlede erhvervsaktive befolkning , naermere betegnet 30 % ;

hvad angaar fastlaeggelsen af omraader , der er ramt af saerlige ulemper , og som kan sidestilles med de ugunstigt stillede omraader , omhandlet i artikel 3 , stk . 5 , i direktiv 75/268/EOEF , er der taget hensyn til saavel ugunstige naturbetingede produktionsvilkaar ( skraaninger , meget kraftig vind , ugunstige vandbygningsforhold for landbruget ) som ulemper som foelge af den geografiske beliggenhed ( insulaer beliggenhed ) ; arealet af disse omraader overstiger desuden ikke 2,5 % af denne medlemsstats samlede areal ;

arten af og niveauet for de ovennaevnte kendetegn , som Det forenede Kongeriges regering har lagt til grund med henblik paa at afgraense de omraader , der er meddelt Kommissionen , svarer til de saerlige kendetegn for de ugunstigt stillede landbrugsomraader , der er naevnt i artikel 3 , stk . 4 og 5 , i direktiv 75/268/EOEF -

UDSTEDT FOELGENDE DIREKTIV :

Artikel 1

De i Det forenede Kongerige beliggende omraader , der er anfoert i bilaget , udgoer en del af faellesskabslisten over ugunstigt stillede landbrugsomraader i henhold til artikel 3 , stk . 4 og 5 , i direktiv 75/268/EOEF .
